The Ministry of Agriculture and Environment received a petition from voters in Bac Ninh province with the following content: Request the Ministry of Agriculture and Environment to supplement administrative procedures issued with Decision No. 2304/QD-BNNMT dated June 23, 2025 of the Ministry of Agriculture and Environment to issue Land Use Rights Certificates for some cases where plots of land have been granted Land Use Rights Certificates as agricultural land, however, land users have arbitrarily (violated) built houses on agricultural land since 2010, and are now eligible for a Certificate of Land Use Rights according to Clause 3, Article 139 of the 2024 Land Law.
Regarding this opinion, the Ministry of Agriculture and Environment would like to report to the National Assembly Delegation and voters of Bac Ninh province as follows: Implementing the 2024 Land Law and decrees of the Government, the Ministry of Agriculture and Environment issued Decision No. 2304/QD-BNNMT dated June 23, 2025 on promulgating administrative procedures in the field of land under the state management of the Ministry of Agriculture and Environment, in which the administrative procedures for "Registering and granting Certificates for cases of households and individuals using land for purposes other than those recognized by the State before July 1, 2014" (code TTHC 1,013993) replace the administrative procedure "Registering land and assets attached to land for cases of households and individuals not using land for purposes other than those assigned by the State, receiving land for land allocation for purposes other than those assigned by the State on December 1, 2014 (code TTHC 1,0813, date of issuance of the Government's decision No. 1, 2024).
In addition, implementing Decree No. 226/2025/ND-CP dated August 15, 2025 of the Government amending and supplementing a number of articles of the decrees detailing the implementation of the Land Law, the Ministry of Agriculture and Environment issued Decision No. 3380/QD-BNNMT dated August 25, 2025 on announcing newly issued administrative procedures; amended and supplemented in the field of land under the state management functions of the Ministry of Agriculture and Environment, in which the administrative procedures for amending and supplementing the procedure "Registering and granting Certificates for cases of households and individuals using land for purposes other than those recognized by the State before July 1, 2014" (code TTHC 1,013993).
Thus, the Ministry of Agriculture and Environment has issued full administrative procedures for registration and issuance of Certificates for cases of households and individuals using land for purposes other than those that have been recognized by the State for land use rights before July 1, 2014 according to regulations.
