Hundreds of BT projects are stuck due to lack of unified guidance
Sharing with Lao Dong reporter, Mr. Le Hoang Chau - Chairman of the Ho Chi Minh City Real Estate Association (HoREA) - said that the Association has just issued Document No. 133/2025/CV-HoREA dated October 13, 2025 to the National Assembly Standing Committee, giving additional comments to the draft Resolution stipulating a number of mechanisms and policies to remove difficulties and obstacles in organizing the implementation of the Land Law.
In particular, the focus is on recommending amendments and supplements to regulations on land fund payment for BT (build - transfer) contracts to completely resolve the problems that have been pending for many years.
Mr. Le Hoang Chau said that many BT projects across the country have been completed and handed over to the State but have not yet been paid with land funds due to regulations on the time of determining land prices. "There are currently no unified instructions, so each locality understands and applies them in a unique way, causing hundreds of BT projects to be stalled for many years," he said.

In the document sent to the National Assembly, HoREA proposed adding a transitional regulation at Point c, Clause 8, Article 5 of the draft Resolution, to clarify how to calculate land prices for BT contracts signed and complete the handover before July 1, 2025.
"The time to determine the land price of the land fund for BT projects must be calculated at the time of project establishment, bidding documents or contract signing" - Mr. Chau commented.
According to him, this is a reasonable solution, helping to remove obstacles for many investors and ensuring the principle of not being complacent, avoiding losses due to delays from management agencies.
Proposal to issue a decree to remove common problems for BT enterprises
The President of HoREA said that the Association also recommended that the National Assembly and the Government consider issuing a new decree similar to Decree 91/2025/ND-CP, but applicable to all businesses with legal BT contracts.
It would be unfair if the Government only issued Decree 91/2025/ND-CP to support one enterprise without removing difficulties for other enterprises Mr. Chau emphasized.
According to him, the issuance of a unified decree will help create a synchronous legal basis, reduce disputes and risks and promote the completion of key infrastructure projects.
"BT investors have spent capital to carry out the project and hand it over to the State, so if they continue to have problems with payment, it will cause double losses - both for businesses and for the budget because the project is slow to exploit the value of the counterpart land" - Mr. Chau emphasized.
According to the Chairman of HoREA, removing obstacles to paying land funds for BT contracts is not only to support businesses but also to create trust for the private sector, encouraging them to continue to participate in infrastructure investment in the form of public-private partnership.
"This is an important socialized capital flow, if unblocked, it will contribute to promoting growth, reducing the burden on the State budget and helping the real estate market develop more healthily" - Mr. Chau shared.
