On the Government Portal, Mr. D.V.H in Da Nang reflected that currently, apartment or rental housing projects under 5 floors, with a road surface of 7.5 m in Da Nang City must carry out the same design, approval and acceptance of fire prevention and fighting as large projects.
The above regulation aims to ensure fire safety but reveals many shortcomings such as: high cost, complicated procedures; extended procedures; not suitable for practice (most works under 5 floors only serve a maximum of 1015 rooms, less risk of large-scale fire and explosion, but are still subject to regulations such as high-rise buildings).
Mr. H suggested that competent authorities consider and adjust regulations on exemption or reduction of fire prevention and fighting approval requirements for works under 5 floors, with a floor area of less than 1,000 m2 and not using gas systems or dangerous industrial equipment.
According to him, it is only necessary to apply basic fire prevention and fighting measures, such as fire extinguishers, escape lights, fire prevention and fighting regulations and periodic fire prevention and fighting training.
At the same time, simplify procedures, shorten acceptance procedures, apply online registration mechanisms and periodic inspections after the project is put into use.
Assign the ward and commune authorities to coordinate in guiding and supervising instead of forcing homeowners to hire high-cost consulting units. Providing financial support and training, organizing free fire prevention and fighting training sessions for landlords. There is a policy to support basic equipment costs for small projects to improve actual safety instead of focusing only on documents.
Regarding this issue, the Ministry of Public Security responded as follows:
On November 29, 2024, the National Assembly passed Law on Fire Prevention, Fire Fighting and Rescue No. 55/2024/QH15, which includes many new regulations.
Implementing the Law, Decree No. 105/2025/ND-CP detailing a number of articles and measures to implement the Law on Fire Prevention, Fire Fighting and Rescue effective from July 1, 2025 has cut down on many administrative procedures, reducing the scale of works subject to fire prevention and fighting design appraisal.
Accordingly, from July 2025, for housing projects such as apartment buildings, collective houses with 7 floors or more or with a total floor area of 3,000 m2, they will be subject to fire prevention and fighting design appraisal at specialized management agencies, the rest will be self- appraised by investors according to the provisions of the law on fire prevention, fire fighting and rescue.
Regarding the settlement of administrative procedures: Administrative procedures are settled in the electronic environment through the Public Service Portal, removing many difficulties and obstacles, creating favorable conditions for people and businesses for the purpose of economic and social development.
For propaganda, dissemination and education, the fire prevention, fire fighting and rescue police force has a plan to organize propaganda, dissemination of knowledge and free training on fire prevention and fighting for people every month and every quarter to improve the effectiveness of fire prevention and fighting.
In the coming time, legal policies on fire prevention and fighting will continue to be studied to effectively implement and achieve economic development goals.
