Authority to train and foster fire prevention and fighting skills

The Lao Dong Newspaper Legal Consulting Office replied:

Clause 2, Article 13, Circular 36/2025/TT-BCA of the Ministry of Public Security stipulates the authority to train and foster fire prevention, fire fighting, rescue and relief operations:

a) Training facilities on fire prevention, fire fighting, rescue: training on fire prevention, fire fighting, rescue and relief for people assigned to conduct fire prevention and fighting inspections at facilities in Group 1, Appendix II attached to Decree No. 105/2025/ND-CP; training and fostering on fire prevention, fire fighting, rescue and relief for Chairmen and Vice Chairmen of the People's Committees at the commune level and for subjects specified in Point b of this Clause when requested; fostering on fire prevention, fire fighting, rescue and relief for people assigned to conduct fire prevention and fighting inspections at facilities in Group 1, Appendix II attached to Decree No. 105/2025/ND-CP when requested;

b) The Fire Prevention, Fire Fighting and Rescue Police Department trains and fosters fire prevention, fire fighting, rescue and relief skills for subjects specified in Points c, d, dd, e, g and Point i, Clause 1, Article 45 of the Law on Fire Prevention, Fire Fighting and Rescue under Party and State agencies at the Central level, economic groups, and corporations when requested, except for those assigned to conduct fire prevention and fighting inspections at facilities in Group 1, Appendix II attached to Decree No. 105/2025/ND-CP by fire prevention, fire fighting, rescue training institutions and members of the Civil Defense Team;

c) Fire Prevention, Fire Fighting and Rescue Police Department of the Provincial Police: train fire prevention, fire fighting, rescue and relief for subjects specified in Clause 1, Article 45 of the Law on Fire Prevention, Fire Fighting and Rescue when requested, except for subjects assigned to conduct fire prevention and fighting inspections at facilities in Group 1, Appendix II attached to Decree No. 105/2025/ND-CP by fire prevention, fire fighting, rescue and relief training institutions; train fire prevention, fire fighting, rescue and relief for subjects specified in Clause 1, Article 45 of the Law on Fire Prevention, Fire Fighting and Rescue when requested.

In case there is a proposal to organize training and fostering fire prevention, fire fighting, rescue and relief for individuals who are subjects trained and fostered in fire prevention, fire fighting, rescue and relief at the grassroots level managed by the People's Committee at the commune level, Village Heads, Heads of Residential Groups, members of the Civil Defense Team under the management of the People's Committee at the commune level, the Fire Prevention, Fire Fighting and Rescue Police Department of the Provincial Police shall preside over and coordinate with the Commune-level Police to organize the implementation.

Thus, the authority to train and foster fire prevention and fighting is regulated as above.
