New regulations on converting rice-growing land in projects

The Government issued Decree No. 226/2025/ND-CP amending and supplementing a number of articles of the Decrees detailing the implementation of the Land Law effective from August 15.

This Decree has many notable amended regulations on rice land as follows:

Amend and supplement Article 50 (Decree No. 102/2024/ND-CP dated July 30, 2024 of the Government detailing the implementation of a number of articles of the Land Law) on the order and procedures for approving the conversion of rice-growing land, special-use forest land, protective forest land, and production forest land to other purposes as follows:

The competent land management agency at the commune level is responsible for synthesizing the demand and making a list of projects that must change the purpose of using rice-growing land, special-use forest land, protective forest land and production forest land to implement investment projects in the area, except for the cases specified in Clause 4, Article 67 of the Land Law.

The People's Committee at the commune level shall submit to the People's Committee at the provincial level for approval a list of projects requiring conversion of land use purposes with rice-growing land, special-use forest land, protective forest land, and production forest land.

The provincial People's Committee shall have a document approving the list of projects that must change the purpose of land use with rice-growing land, special-use forest land, protective forest land, and production forest land.

In case of converting the purpose of using rice-growing land, special-use forest land, protective forest land and production forest land to other purposes without having to establish an investment project according to the provisions of the law on investment, it is not necessary to carry out the procedures prescribed in Clauses 1, 2 and 3 of this Article.

Converting crop structure on rice-growing land

Amending and supplementing a number of articles of Decree No. 112/2024/ND-CP dated September 11, 2024 of the Government detailing rice-growing land as follows:

Plan to convert crop and livestock structure on rice-growing land

The Chairman of the Provincial People's Committee shall base on the planning and land use plan at the provincial level approved by competent authorities in accordance with the provisions of law, the proposal of the Chairman of the Commune People's Committee and the proposal of the specialized agency on agriculture and environment at the provincial level, issue a Plan to convert the structure of crops and livestock on rice-growing land throughout the province according to the form in Appendix I issued with this Decree; the issuance time is before November 30, the previous year of the plan year.

The Chairman of the People's Committee at the commune level shall base on the approved plan for converting crop and livestock structure on rice-growing land and the conversion needs of rice-growing land users, issue a plan for converting crop and livestock structure on rice-growing land in the commune according to the form of Appendix III issued with this Decree; the time of issuance is before December 30, the previous year of the plan year.
