Responding to the above issue, the Ministry of Agriculture and Environment said that according to the provisions of Point a, Clause 1, Article 172 of the 2024 Land Law, the term for land allocation and recognition of agricultural land use rights for individuals directly engaged in production is 50 years, applicable to land for annual crops, perennial crops, aquaculture, salt production, production forests are planted forests.
When the term expires, individuals are allowed to continue using land under the new term without having to carry out extension procedures.
According to the Ministry of Agriculture and Environment, for agricultural land specified in Point a, Clause 1, Article 172 of the 2024 Land Law, when the land use term expires (50 years), it is allowed to continue to use the land for the prescribed period (50 years) without having to carry out extension procedures, even when exercising the rights specified in Clause 1, Article 174 of the 2024 Land Law.
Regarding the extension of land use term of the transferee of land use rights from an individual directly engaged in agricultural production, this content has been stipulated in Clause 1, Article 174 of the 2024 Land Law.
Accordingly, the land use term when receiving the transfer of land use rights for land types with a term regulated is the remaining land use period of the land use term before receiving the transfer of land use rights.
The extension of land use shall be implemented in accordance with the provisions of Clause 3, Article 172 of this Law.
In case of receiving the right to use agricultural land within the land allocation limit of an individual directly engaged in agricultural production through receiving the transfer of land use rights, or receiving the right to use land in a mortgage contract to settle debts, judgments, decisions of the court, and decisions to enforce judgments of the enforcement agency that have been enforced but have expired the land use term, they are allowed to continue using the land within the term prescribed in Article 172 of this Law without having to carry out extension procedures.
