Citizens sent questions to the Ministry of Agriculture and Environment asking about the following case: Mr. B received the transfer from Mr. A on April 20, 2025, and Mr. A had previously been sent a notice of land reclamation by the People's Committee of the district (old). On May 5, 2025, the compensation and site clearance unit came to inventory the assets on the recovered land and notified it as an incorrect land user.
Citizens ask, when the State has issued a notice of land recovery after the 2024 Land Law comes into effect, will the people have the right to transfer or donate the land plot that has been notified of recovery? If the transfer is allowed, and the user is Mr. A who transferred the transfer to Mr. B, must the revocation notice from Mr. A to Mr. B be adjusted?
Regarding compensation, support and resettlement plans, are policies on stabilizing life supported for people in Mr. B's household? Can I consider resettlement or other policies for Mr. B?
Responding to this content, the Ministry of Agriculture and Environment said that at Point d, Clause 2, Article 95 of the Land Law, the conditions for compensation for land when the State reclaims land for national defense and security purposes; socio-economic development for national and public interests when meeting the conditions: Receiving the transfer of land use rights according to the provisions of law from a person with legal land use rights but has not completed the land registration procedures.
Therefore, if they are eligible for land use rights transfer according to the provisions of law from a person with legal land use rights specified in Point d, Clause 2, Article 95 of the Land Law, they are eligible for land compensation.
Land compensation and resettlement arrangements for people eligible for land compensation are implemented in accordance with Clause 2, Article 91, Clause 1, Article 98, Point d, Clause 1, Article 108, Article 111 of the Land Law.
The Ministry recommends that citizens refer to, research and contact competent land management agencies in the locality for specific instructions and answers.
