Pursuant to Point e, Clause 2, Article 23 of the 2023 Law on Real Estate Business, the rights of tenants to buy future housing are stipulated as follows:
Article 23. Principles of housing business and construction works formed in the future
2. The purchase and sale, hire-purchase of houses, construction works, and construction floor area in future construction works shall comply with the following regulations:
e) The right of the buyer or lessee to buy houses, construction works, and construction floor area in construction works formed in the future shall comply with the provisions of Clause 1 and Clause 2, Article 20 of this Law.
Thus, the rights of the lessee to buy a future housing include:
- Request the seller or lessee to complete the procedures for buying and selling houses, construction works, and construction floor areas in construction works within the agreed time limit in the contract.
- Request the seller or lessee to buy and sell houses, construction works, construction floor area in construction works in accordance with the agreed terms, quality and other conditions in the contract; hand over the certificate of land use rights, ownership of assets attached to land according to the provisions of the law on land and related documents according to the agreed contract.
- Request the seller or lessee to buy a security deposit for a house, construction works, and the construction floor area in a construction work according to the agreement in the contract and the provisions of law.
- Request the seller or lessee to compensate for damages caused by the allocation of houses, construction works, construction floor area in construction works that are not on time, quality and other commitments in the contract.
- Other rights under the contract.
- Renting part or all of houses, construction works, and construction floor area in construction works; being transferred a house and construction works lease contract according to the provisions of Article 49 of the Law on Real Estate Business 2023.
- Request the lessor to buy and repair damaged houses, construction works, and construction floor areas in construction works within the lease term without causing fault.
- Request the lessor to compensate for damages caused by the lessor's errors.
- Have the right to own a house, a construction work, or a construction floor area in a construction work from the time the lessee has paid the full amount.
