Pursuant to Clause 2, Article 4 of Circular 56/2024/TT-BTC, the following provisions on cases of exemption when requesting the exploitation and use of land documents from the National Land Information System are applied:
a) Subjects specified in Clause 1, Article 10 of the Law on Fees and fees for exploiting their information and exploiting information of other land users when having the consent of the national land database management agency as prescribed by the law on land.
b) Ministers, Heads of ministerial-level agencies, government agencies, Chairmen of People's Committees of provinces and centrally run cities shall have documents proposing to exploit and use information and land data from the National Land Information System to serve:
- National defense and security purposes in emergency situations as prescribed by the Law on National Defense.
- Prevention and control of natural disasters in emergency situations according to the provisions of law on natural disaster prevention and control.
c) Exemption cases specified in Article 62 of Decree No. 101/2024/ND-CP dated July 29, 2024 of the Government.
According to Clause 1, Article 10 of the Law on Fees and Charges 2015, the subjects exempted from and reduced from fees and charges are as follows:
- Subjects subject to exemption and reduction of fees and charges include children, poor households, the elderly, people with disabilities, people with revolutionary contributions, ethnic minorities in communes with particularly difficult socio-economic conditions and some special subjects as prescribed by law.
Pursuant to Clause 4, Article 62 of Decree 101/2024/ND-CP, the fees for exploiting and using land documents and the price for providing information services and land data from the National Land Information System are as follows:
- Exemption and reduction of fees when exploiting and using land documents from the National Land Information System is implemented in accordance with the provisions of law on fees and charges.
In case of serving national defense, security, and disaster prevention and control purposes, they are exempted or reduced according to the provisions of law; exempted for ministries, branches and localities when connecting and sharing national land databases with other national databases, databases of ministries, branches and localities to share information and land data to serve the activities of state agencies and resolve administrative procedures, simplify administrative procedures for people and businesses according to the Government's regulations on management, connection and sharing digital data of state agencies.
Thus, according to the law, when requesting a copy of the red book, the fee is exempted in the following cases:
- Poor households, the elderly, people with disabilities, people with revolutionary contributions, ethnic minorities in communes with special difficulties and special subjects according to the law exploit personal information and information of other land users when approved by the land data management agency according to the law;
- Ministers, heads of ministerial-level agencies, government agencies, and Chairmen of provincial and municipal People's Committees propose exploiting land information from the National System to serve national defense, security, and natural disaster prevention and control purposes in emergency situations;
- Exemption and reduction of land document exploitation fees in accordance with legal regulations. Free connection, sharing of land data between state agencies, supporting management, handling administrative procedures, and simplifying processes for people and businesses.
