At the 9th Session, on the morning of June 11, General Phan Van Giang - Politburo member, Minister of National Defense, authorized by the Prime Minister, presented the draft Law on amending and supplementing a number of articles of the Law on National Defense; Law on People's Army Officers; Law on Professional Soldiers, Workers and National Defense Officials; Law on Military Service; Law on Border Guard of Vietnam; Law on People's Air Defense; Law on reserve Forces; Law on Civil Defense; Law on Management and Protection of National Defense and Military Zones; Law on Militia and Self-Defense Forces; Law on Education, National Defense and Security.
General Phan Van Giang said that the draft Law focuses on amending and supplementing a number of articles on position, role, authority, functions, and tasks in the military and defense sector related to the organization of local governments at both levels.
Regarding amending and supplementing a number of provisions of the Law on National Defense, related to the arrangement of the apparatus of the political system on the organization of local government at 2 levels, amending and supplementing a number of points such as determining the construction of regional defense, building commune level as a foundation for local protection.
The People's Committee at the provincial level shall issue a boundary order in one or more localities at the commune level and the People's Committee at the commune level shall issue a boundary order in one or more areas under its management.
Amend and supplement a number of provisions of the Law on Officers of the Vietnam People's Army such as removing a number of titles of Commander, Political Commissar of the Provincial Border Guard Command, Deputy Commander, Deputy Political Commissar of the Provincial Border Guard Command, Commander, Political Commissar of the District Military Command, Deputy Commander, Deputy Political Commissar of the District Military Command.
The removal of some of these titles is to ensure compliance with the arrangement of local military organizations "streamlined, compact, strong" to meet the requirements of tasks in the new situation.
Supplement the responsibility of the Chairman of the Provincial People's Committee to decide to call up reserve officers for training and call up reserve officers to serve in the army, train, check readiness to encourage and prepare for combat for cadres, civil servants, and reserve non-commissioned officers residing in the locality.
Amend and supplement a number of provisions of the Law on Professional Soldiers, Workers and National Defense Officials such as transferring the authority from the Commander of the District Military Command to the Commander of the Area Defense Command to decide on the dismissal of professional soldiers who have expired or are no longer healthy enough to serve in the reserve rank due to no longer being at the district level.
Amend and supplement a number of provisions of the Law on Military Service such as transferring the authority of the district level to the provincial level for the following tasks: Establishing a Military Service Health Examination Council; deciding on the list of citizens called for military service, performing their duties to join the People's Public Security, and a list of temporary deferrals and exemptions from military service.
Transfer the authority of the district level to the commune level for some tasks: Check the health of non-commissioned officers and reserve soldiers; issue an order to call each citizen: Register for initial military service, pre-scrutine and check health for military service, call up for military service and perform their duty to join the People's Public Security.
Transfer the authority of the District Military Command to the Decision Area Defense Command.
