Phu Tho Provincial People's Committee has just issued Decision No. 17/2026/QD-UBND stipulating compensation based on actual damage for cases where houses and works serving life attached to land are partially dismantled but the remaining part still meets technical standards when the State recovers land.
Regulations applicable to land management agencies, construction management agencies, units implementing compensation, support, and resettlement; Commune-level People's Committees and organizations and individuals related to compensation work when land is recovered.
At the same time, it applies to people whose land is recovered and homeowners of houses and works attached to land.
According to regulations, the scope of damage compensation includes houses, demolished works and items necessary for handling, ensuring structural safety, completing the remaining part as well as maintaining the function of use for legal purposes.
Notably, in the case where the land acquisition boundary is between load-bearing structural parts, if the technical assessment results show that it is necessary to dismantle or handle adjacent structural parts to ensure safety, the arising area and volume will also be included in the damage for compensation.
For houses and works that are demolished, the compensation level is determined based on actual damage.
The compensation level is equal to 100% of the new construction value of the affected part according to the compensation unit price issued by the Provincial People's Committee at the time of preparing the compensation plan.
In case the type of project or item is not in the current unit price list, the compensation implementing unit will hire a consulting unit to determine the value as a basis for calculation. The rental cost will be included in the cost of organizing the implementation of compensation, support, and resettlement of the project.
For the work part that needs to be processed in the remaining part of the project, the compensation level is determined according to the actual volume needed, based on the technical evaluation results to ensure safety, stability of the project and maintain the function of use, excluding items of renovation or upgrading beyond the original state.
