Regulations on support for access to land and production and business premises according to Resolution 198

Resolution 198/2025/QH15 stipulates many policies to support small, medium and startups in accessing land.

Pursuant to Article 7 of Resolution 198/2025/QH15, which stipulates support for land access and production and business premises from May 17, 2025 as follows:

(1) Localities are allowed to use local budgets to partially support investment in the construction of infrastructure systems for industrial parks, industrial clusters, and technology incubation gardens. The supported contents include: supporting land acquisition, compensation, resettlement; supporting investment in transport infrastructure works, supplying electricity, water supply, drainage, wastewater treatment and communication.

(2) Investors in infrastructure business in industrial parks, industrial clusters, and technology nursery areas supported for investment according to the provisions of Point (1) must reserve a part of the land area invested in infrastructure for high-tech enterprises in the private economic sector, small and medium enterprises, and creative startups to lease or sublease. Not applying the provisions of law on management and use of public assets for assets formed from investment support capital as prescribed in (1)

(3) Based on the actual situation and the ability to balance local budgets, the Provincial People's Committee shall prescribe principles, criteria, investment support norms and determine the land area with infrastructure investment of industrial parks, industrial clusters, and technology kindergartens for high-tech enterprises in the private economic sector, small and medium enterprises, and creative startups to lease and sublease as prescribed in (1) 2.

(4) For industrial parks and industrial clusters established after Resolution 198/2025/QH15 effective implementation, the provincial People's Committee base on the actual situation, determine the land area for each industrial park and industrial cluster that has invested in building an average infrastructure system to ensure an average of 20 hectares/industrial parks, industrial clusters or 5% of industrial and industrial land areas in the area of ​​industrial and industrial clusters in the area of ​​industrial and industrial clusters in the area of ​​industrial and industrial clusters Nhan, small and medium -sized enterprises, creative start -ups hire and sublease.

(5) In case of industrial parks and industrial clusters established in accordance with (4) without receiving the State's investment support to build infrastructure systems of industrial parks and industrial clusters. After 2 years from the date the industrial park and industrial cluster completed the investment in the construction of infrastructure systems without high -tech enterprises in the private economic sector, small and medium -sized enterprises, creative start -up enterprises rented and leased, the investor of infrastructure business in industrial parks and industrial clusters is entitled to other enterprises to lease and lease.

(6) High-tech enterprises in the private economic sector, small and medium enterprises, and creative startups are supported with a minimum reduction of 30% of land re-lease within the first 5 years from the date of signing a land lease contract with investors in infrastructure business of industrial parks, industrial clusters, and technology incubation gardens. This land rental support amount will be refunded by the State to the investor according to Government regulations. The provincial People's Committee decides on the level of land lease reduction prescribed in (6).
