Hai Phong voters recommend that the Ministry of Construction advise the National Assembly to promptly review, amend and supplement related laws such as: Law on Urban and Rural Planning, Law on Construction... to ensure compliance with the 2-level local government model.
After studying, the Ministry of Construction responded as follows:
Conducting a review of laws related to the two-level local government model, the Ministry of Construction has been continuing to summarize and propose the development of legal documents to promptly institutionalize the Party's policies, perfect legal documents with content on decentralization and delegation of power, in line with the 02 level local government model.
The draft law aims to reduce and simplify administrative procedures and business investment conditions, ensuring the consistency and synchronization of the legal system, feasibility and suitability with reality.
The Ministry of Construction has proposed amending the Construction Law and amending and supplementing a number of articles of the Law on Urban and Rural Planning to the 2025 Legislative Program, expected to be submitted to the National Assembly for approval at the October 2025 Session, specifically as follows:
The Construction Law Project has been submitted to the Government in Submission No. 101/TTr-BXD dated September 10, 2025. Accordingly, the Ministry of Construction has reviewed the entire draft to study and amend regulations in accordance with the 2-level local model such as: Amending regulations on granting construction permits; amending the form of Construction Investment Project Management Boards to increase proactiveness and flexibility for localities in organizing implementation.
Review a number of contents on decentralization and delegation of authority in the field of construction investment management in Decree No. 144/2025/ND-CP dated June 12, 2025 of the Government regulating decentralization and delegation in the field of state management of the Ministry of Construction to include in the draft Law to ensure consistency and synchronization when implementing the 2-level local government model.
Remove specific regulations on authority, content, and order in the Construction Law such as: Design content of the facility; procedures, appraisal documents Feasibility study report; appraisal time; documents requesting a construction permit; process, authority to issue, reissue, adjust, extend, revoke, cancel construction permits; preparation of construction sites, detailed regulations on construction capacity conditions; regulations on authority to issue construction practice certificates... creating favorable conditions for people and businesses to participate in construction investment activities.
The draft Law amending and supplementing a number of articles of the Law on Urban and Rural Planning has been submitted to the Government in Submission No. 102/TTr-BXD dated September 12, 2025.
The Ministry reviews regulations on the division of responsibilities and authority of local authorities at 02 levels, decentralization and delegation of authority for urban and rural planning in documents regulating the division of responsibilities, authority and decentralization and delegation of authority for urban and rural planning (Decree No. 145/2025/ND-CP), documents regulating the handling of difficulties and obstacles in legal regulations on urban and rural planning (Resolution No. 66.1/2025/NQ-CP) to ensure consistency and synchronization with legal regulations.
Adjust regulations in the direction of simplifying processes and procedures for establishing, appraising and approving zoning plans.
Remove regulations on Town Master Plan, New Urban Master Plan expected to become Town and District Master Plan and some other contents to comply with local government organizations at 02 levels, in accordance with the content of the draft Resolution of the National Assembly Standing Committee on standards for classifying administrative units, requirements to promote decentralization, delegation of authority...
The Ministry of Construction plans to continue proposing amendments and supplements to the 2026 Law Program to ensure compliance with the 2-level local model; cutting and simplifying administrative procedures, investment and business conditions, ensuring the unity and synchronization of the legal system, feasibility, and suitability with reality.
The Ministry of Construction added that the two draft laws expected to be submitted to the National Assembly at the May 2026 Session include: Draft Law amending and supplementing a number of articles of the Housing Law; Draft Law amending and supplementing a number of articles of the Real Estate Business Law.
2 draft laws expected to be submitted to the National Assembly at the October 2026 Session: the draft Vietnam Maritime Code; the draft Law amending and supplementing a number of articles of the Architecture Law.
