Multi-purpose agricultural land use without conversion

Agricultural land used in combination with commercial, service, livestock and medicinal plant growing purposes does not need to be converted.

What purposes does agricultural land use not require conversion?

Pursuant to Point a, Clause 1, Article 218 of the 2024 Land Law, agricultural land used in combination with commercial, service, livestock, and medicinal plant cultivation purposes does not need to be converted.

At the same time, the use of multi-purpose agricultural land must meet the following requirements:

- Do not change the land type according to the land classification specified in Clause 2 and Clause 3, Article 9 and determined in the documents specified in Article 10 of the 2024 Land Law;

- Does not eliminate the necessary conditions for returning to land use for its main purpose;

- Does not affect national defense and security;

- Limit impacts on the conservation of natural ecosystems, biodiversity, and environmental landscapes;

- Does not affect the land use of adjacent plots;

- Fully perform financial obligations as prescribed;

- Comply with relevant laws.

Scope and conditions of use of multi-purpose agricultural land

According to Clause 2, Article 99 of Decree 102/2024/ND-CP, the scope and conditions for using multi-purpose land are stipulated as follows:

- Using land for combined purposes is not a case of changing land use purposes as prescribed in Article 121 of the 2024 Land Law;

- The land area used for combined purposes must not exceed 50% of the land area used for the main purpose;

- Construction works on agricultural land for multi-purpose use must have appropriate scale and nature and be easy to dismantle. The land area for construction works for multi-purpose use on rice-growing land and forestry land shall comply with the provisions of the Decree detailing rice-growing land and forestry laws. Land with water surface must not be filled to change the flow, water surface area, and water depth;

- Construction and renovation of works for combined purposes must comply with the provisions of the law on construction and other relevant laws;

- The land use period for combined purposes shall not exceed the remaining land use period of the main purpose.
