Pursuant to the provisions of Clause 2, Article 160 of the 2024 Land Law, the authority to decide on specific land prices is stipulated as follows:
a) The Chairman of the Provincial People's Committee decides on specific land prices for land allocation, land lease, permission to change land use purposes, recognition of land use rights, extension of land use, adjustment of land use term, adjustment of detailed construction planning, land recovery, determination of starting price for land use rights auction, determination of land use right value when equitizing enterprises under the authority of the Provincial People's Committee according to the provisions of this Law.
b) The Chairman of the District People's Committee decides on specific land prices for cases of land allocation, land lease, permission to change land use purposes, recognition of land use rights, extension of land use, adjustment of land use term, adjustment of detailed construction planning, land recovery, determination of starting price for land use rights auction under the authority of the District People's Committee according to the provisions of this Law.
In addition, according to Point e, Clause 2, Article 5 of Decree 151/2025/ND-CP (effective from July 1, 2025), the authority of the People's Committee at the district level and the Chairman of the People's Committee at the district level shall be transferred to the Chairman of the People's Committee at the commune level.
- The authority of the Chairman of the District People's Committee according to the provisions of the Land Law shall be transferred to the Chairman of the Commune People's Committee, specifically as follows:
+ Decision on specific land prices for cases specified in Point b, Clause 2, Article 160 of the Land Law.
Thus, from July 1, 2025, the authority to decide on specific land prices in cases of land use extension that previously belonged to the Chairman of the District People's Committee will be transferred to the Chairman of the Commune People's Committee.
Accordingly, the Chairman of the Provincial People's Committee and the Chairman of the Commune People's Committee will be the competent authorities to decide on specific land prices in case of extension of land use term.
