According to Point e, Clause 2, Article 5 of Decree 151/2025/ND-CP (effective from July 1, 2025), one of the powers of the Chairman of the District People's Committee as prescribed by the 2024 Land Law will be transferred to the Chairman of the Commune People's Committee for implementation, including specific land price decisions.
Accordingly, Clause 2, Article 160 of the 2024 Land Law stipulates the authority to decide on specific land prices as follows:
- Chairman of the Provincial People's Committee decides on specific land prices for land allocation and lease, permission to change land use purposes, recognition of land use rights, extension of land use, adjustment of land use term, adjustment of detailed construction planning, land recovery, determination of starting price for land use rights auction, determination of land use right value when equitizing enterprises under the authority of the Provincial People's Committee according to the provisions of the 2024 Land Law;
- The Chairman of the People's Committee at the commune level decides on specific land prices for land allocation, land lease, permission to change land use purposes, recognition of land use rights, extension of land use, adjustment of land use term, adjustment of detailed construction planning, land recovery, determination of starting price for land use rights auction under the authority of the People's Committee at the commune level according to the provisions of the 2024 Land Law.
Thus, according to the new regulations, from July 1, 2025, the Chairman of the Commune People's Committee will be allowed to decide on specific land prices.
Pursuant to Clause 1, Article 160 of the 2024 Land Law, specific land prices are applied to the following cases:
- Calculating land use fees for organizations when the State allocates land with land use fees not for auction of land use rights, not for bidding to select investors to implement projects using land, allocating land with land use fees to winning investors or economic organizations established by winning investors to implement projects using land, recognizing land use rights, allowing change of land use purpose but having to pay land use fees;
- Calculating land rent when the State leases land and collects one-time land rent for the entire lease term, except in cases where it is through auction of land use rights;
- Calculating the value of land use rights when equitizing state-owned enterprises according to the provisions of law on equitization;
- Determine the starting price for auctioning land use rights when the State allocates land or leases land, except for the case specified in Point i, Clause 1, Article 159 of the 2024 Land Law;
- Calculating land use fees and land rents when extending land use, adjusting land use term, adjusting detailed construction planning; allowing change of land use form;
- Calculating compensation when the State reclaims land.
