On May 18, the People's Committee of Thanh Hoa province announced that Vice Chairman of the Provincial People's Committee - Mr. Le Duc Giang signed and issued a Decision to reclaim an area of 9,201,3m2 of land of Nhat Ha Company Limited at plot No. 286, map sheet No. 09, Hai Binh ward.
This project was leased land by the Nghi Son Economic Zone and Industrial Zones Management Board since 2015 but violated the provisions of Clause 8, Article 81 of the 2024 Land Law.
Nghi Son Town People's Committee and Hai Binh Ward People's Committee are assigned to coordinate in supervising the handover of land; if the enterprise does not comply, they will organize compulsory recovery according to the provisions of law.
The Provincial People's Committee assigns the Thanh Hoa Land Fund Development Center to receive and manage the recovered land area. Department of Agriculture and Environment shall assume the prime responsibility for inspecting, handing over the field and processing land use right certificates. In case the enterprise does not hand over papers, the authorities will carry out the cancellation procedures as prescribed.
This revocation demonstrates the determination of local authorities in tightening discipline, strictly handling projects violating land laws, avoiding waste of resources and creating conditions for other investors who need to use land legally and on schedule.
Clause 8, Article 81 of the 2024 Land Law:
"Land allocated, leased, permitted by the State to change the purpose of use, recognize land use rights, receive land use rights transfer to implement investment projects but not used for 12 consecutive months from the date of receipt of land handover on site or the land use progress is 24 months behind the progress recorded in the investment project;
In case of not putting land into use or behind the land use schedule compared to the schedule stated in the investment project, the investor may extend the shelf life not exceeding 24 months and must pay additional money to the State with the amount of money corresponding to the land use fee and land rent for the extended time; At the end of the extension, the investor has not yet put the land into use, the State recovers land without compensation for land and property attached to the land and the cost of investment in the remaining land ".
