The Government Inspectorate has just concluded the inspection of land management and use in accordance with Resolution No. 73/NQ-CP dated September 23, 2019 and Resolution No. 116/NQ-CP dated December 6, 2019 of the Government; planning and implementation of construction planning of Hai Phong City People's Committee.
In this Conclusion, the Government Inspectorate pointed out many limitations and shortcomings in the Residential Area Development Project in Vinh Bao town, invested by Saigon Garment - Match Joint Stock Company.
Regarding planning: The work of preparing and appraising the detailed planning 1/500 and approved in Decision No. 888/QD-UBND dated March 29, 2019 of Vinh Bao District People's Committee has not specifically assessed the works and projects within the planning scope and neighboring areas, has not comprehensively and synchronously studied the functions of the project, to ensure the conditions of land use area (related to the power grid safety system of Vinh Bao Power Company 234m2 and 1,044.3m2 adjacent to National Highway 10 and the wastewater treatment plant of the project's residential area), leading to the need to study, adjust and supplement, which is not in accordance with regulations.
The People's Committee of Vinh Bao District and the Department of Planning and Investment proposed that the People's Committee of Hai Phong City approve the investment project with a scale of 9.8 hectares, without investment phases and the overall implementation plan on a scale of 24.9 hectares according to the detailed planning 1/500 approved by the People's Committee of Vinh Bao District in Decision No. 888/QD-UBND dated March 29, 2019, which is not in accordance with the provisions of Clauses 1 and 3, Article 48 of the 2014 Law on Construction and the objectives of the approved detailed planning project.
Besides, the Government Inspector also pointed out many limitations and shortcomings in determining land prices of this project.
Saigon Garment - Match Joint Stock Company was late in fulfilling its financial obligations regarding land use fees for 18 months since the announcement of Hai Phong tax authority, and by the time of inspection, the amount of late payment had not been paid, which was not in accordance with regulations. According to the report of Hai Phong City People's Committee, after the direct inspection ended, this company has remedied and paid the full land use fees and late payment fees to the State budget.
Notably, Saigon Garment - Match Joint Stock Company has implemented construction of a number of technical infrastructure items without being granted a construction permit. The People's Committee of Vinh Bao District has issued Decision No. 59/QD-XPHC to impose an administrative fine of VND 130 million.
The project has an investment capital of 829.6 billion VND.
The Residential Area Development Project in Vinh Bao Town was approved by the Hai Phong City People's Committee in Decision No. 254/QD-UBND dated July 23, 2021, and approved the investor to implement the project in Decision No. 3355/QD-UBND dated November 22, 2021.
The project investment capital according to Decision 3355/QD-UBND is 829.6 billion VND. Investment in construction of 387 townhouses with area from 90-120m2/unit, frontage from 5-6m wide and maximum height of 5 floors.
At the time of inspection, the Investor was carrying out site clearance, construction of some technical infrastructure items, and drainage system to return to related households.
This project is widely advertised under the name TNR Stars Vinh Bao. This is a project in which the investor, Saigon Garment - Match Joint Stock Company, joins hands with the management and development unit, TNR Holdings Vietnam Real Estate Investment and Development Joint Stock Company.
After the inspection of this project, the Government Inspectorate recommended that the People's Committee of Hai Phong City direct the inspection, review, re-determine and collect additional fees for the state budget (if any) of land use fees, land rent fees at land allocations, changes in land use purposes, adjustments to detailed construction planning that change the land use structure, verify, ensure correctness, completeness, and timeliness of legal effect, and prevent loss of state budget.
