1. How should people handle the red book issued with the wrong land location?
Pursuant to Clause 1, Article 152 of the 2024 Land Law, the following cases of correcting red books are stipulated:
- There are errors in the information of the person granted the Certificate compared to the information at the time of correction.
- There are errors in information about land plots and assets attached to land compared to the records declared when registering land and assets attached to land or shown in the effective document of the competent state agency on land dispute settlement.
Thus, if the process of issuing a red book has errors or confusion of information leading to incorrect personal information, issuance of incorrect land location (false row numbers, plots, map sheet numbers, etc.) compared to the initial declaration documents that have been checked and confirmed by the land registration agency, people can request the competent authority to carry out procedures to correct the red book.
2. How long does it take to adjust information on the wrong land location in the red book?
Pursuant to Clause 8 and Clause 10, Article 22 of Decree 101/2024/ND-CP, the time for carrying out procedures to correct the issued red book is no more than 10 days from the date of receipt of valid documents.
Note: The above time does not include holidays and days off; time for receiving documents and time for performing financial obligations of land users; does not include the time for consideration and handling of cases of land use that violate the law, does not include the time for requesting appraisal.
If the correction documents are not complete or valid, within no more than 3 working days, the dossier receiving agency shall notify and guide to supplement and complete the documents according to regulations.
For mountainous communes, islands, remote areas, remote areas, and areas with difficult socio-economic conditions/especially difficult, the time for carrying out procedures for correcting red books will be increased by 10 days.
