Who is the person whose land is recovered and is supported for employment?
Clause 1, Article 2 of Decision 12/2024/QD-TTg stipulates the people whose land is recovered as follows:
- People belonging to households and individuals receiving support according to the provisions of Clause 2, Article 109 of the 2024 Land Law and documents detailing the Land Law (hereinafter referred to as people whose agricultural land is recovered);
- People belonging to households or individuals as prescribed in Clause 3, Article 109 of the 2024 Land Law (hereinafter referred to as those whose business land is recovered).
Referring to the provisions in Clause 1, Clause 2 and Clause 3, Article 109 of the 2024 Land Law, people whose land is recovered will receive specific employment support, including people from households and individuals below:
(1) Households and individuals directly engaged in agricultural production who are using agricultural land allocated, transferred, inherited, donated, or recognized by the State when the State reclaims land without land for compensation and have been compensated in money.
(2) Individuals subject to social protection, beneficiaries of monthly social allowances according to the provisions of law, war invalids, sick soldiers, and martyrs' families when the State reclaims agricultural land without land for compensation and have been compensated in money.
(3) Households and individuals using land due to land allocation for use for agricultural, forestry, aquaculture from agricultural and forestry farms or agricultural and forestry companies are converted from agricultural and forestry farms directly producing agricultural and stable income from agricultural production on that land, except for individuals who are officials and employees of agricultural and forestry and forestry and forestry and forestry and forestry The state has retired, loses labor, and resigns to benefit from benefits.
(4) Households and individuals using land due to receiving land allocation from agricultural production groups and agricultural cooperatives that are directly engaged in agricultural production and have a stable source of income from agricultural production on that land.
(5) Households and individuals using residential land in combination with service business have a stable source of income from service business activities, when the State reclaims land and has to relocate their residence.
Employment support period for people whose land is recovered
Pursuant to Article 4 of Decision 12/2024/QD-TTg, the State's support period for job creation and vocational training for people whose land is recovered is as follows:
- People whose land is recovered are entitled to support policies for a period of 5 years from the date of the Decision on land recovery.
Thus, people whose land is recovered are entitled to the State's employment support policy for a period of 5 years from the date of the Decision on land recovery.
