Regarding the content of the Land Use Rights Certificate (red book) issued before the implementation of the two-level government, whether people have to change it to the name of the new administrative unit or not, the Hanoi Land Registration Office has responded to this content.
According to Mr. Pham Van Tinh - Deputy Director of the Hanoi Land Registration Office, this issue is of great concern to the people. According to Point a, Clause 1, Section VII, Container C, Part V, Appendix I issued with Decree No. 151/2025/ND-CP dated June 12, 2025 of the Government, on determining the authority of local authorities at two levels in the field of land, in cases of merger, renaming of communes and wards, it is not mandatory to reissue the Certificate.
However, when people carry out procedures for registration of changes (such as transfer, inheritance, mortgage, plot separation, etc.), the Land Registration Office system will proactively update new administrative locations on the Certificate to ensure consistency of management information.
This is a way to avoid unnecessary administrative procedures and ensure the legal rights of the people.
Regarding the handling of records for separation, consolidation of plots or issuance of new Certificates currently applied according to old or new administrative locations, according to Mr. Pham Van Tinh, this issue is specifically guided by the city in Article 4 - Transitional regulations of Decision No. 40/2025/QD-UBND dated July 1, 2025 of the Hanoi People's Committee.
Accordingly, the conditions, limits and classification of communes and wards in the division and separation of land plots are still applied according to the administrative boundaries of districts, towns and cities before the arrangement until new regulations are issued to replace them.
Thus, people in newly merged communes and wards are still subject to the old regulations to ensure stability and avoid disruption in the process of processing documents.
To implement the agreement, on July 8, 2025, the Department of Agriculture and Environment issued Document No. 4170/SNNMT-TKDD&DDBD and 4189/SNNMT-TKDD&DDBD to the system of the Land Registration Office and People's Committees of communes and wards. These two documents provide detailed instructions on the implementation of determination and decentralization in the land sector according to the 2-level government model.
Thanks to timely guidance, the process of handling documents on division, consolidation, transfer, inheritance, and issuance and exchange is still taking place normally.
