On June 23, 2025, the Ministry of Agriculture and Environment issued Decision 2304/QD-BNNMT on the announcement of administrative procedures in the land sector under the state management of the Ministry of Agriculture and Environment.
Step 1: The land user submits the application to one of the locations in the provincial level: Public Administration Service Center or Land Registration Office or Branch of the Land Registration Office.
- When submitting the application, the registered candidate can choose to submit a copy of the document and present the original to the officer receiving the application for comparison inspection or submit the original document or submit a notarized or certified copy of the document. In case of submitting the application online, the application must be digitized from the original or a certified and certified copy of the document.
- In case of confirming changes on the issued certificate, the registration submits the original of the issued certificate.
- In case of submitting a copy or digitized copy of all documents, when receiving the results of handling administrative procedures, the registered candidate must submit the original documents in the dossier components according to regulations. Except for documents such as construction permits, investment project approval decisions, investment decisions, investment licenses, investment certificates, approval decisions or decisions approving adjustments to detailed construction planning, maps to adjust detailed construction planning.
Step 2: The dossier receiving agency implements
- Check the completeness of the dossier components and issue a dossier receipt and schedule a return of results.
- In case the documents are not complete, the documents and the supplement and completion request form will be returned so that the applicant can register to complete and supplement according to regulations.
- In case the Public Administration Service Center receives the dossier, the dossier shall be transferred to the Land Registration Office, Branch of the Land Registration Office.
Step 3: The Land Registration Office, Branch of the Land Registration Office shall implement
* Check records and information about land users, boundaries, areas, and types of land of land plots on archived records.
* Refer to the provisions of Article 220 of the 2024 Land Law to determine the conditions for land division and land consolidation:
- Within 3 working days from the date of receipt of the complete dossier, the Land Registration Office, the Branch of the Land Registration Office shall return the dossier to the land user and clearly notify the reasons in case:
+ Documents that are not eligible for land division or consolidation or in cases where the dossier is eligible for land division or consolidation but the issued certificate does not have a land plot diagram or has a land plot diagram but lacks edge size or the area and edge size are not uniform.
- In case not subject to the above regulations, within 05 working days from the date of receipt of the complete dossier, the Land Registration Office, Branch of the Land Registration Office shall confirm the eligibility for land division, land consolidation with land plot information.
+ In case of land division or consolidation without changing the land user, the Land Registration Office, Branch of the Land Registration Office shall make corrections and updates on changes in land records and land database. Issuing certificates of land use rights and ownership of assets attached to land for land plots after land division and consolidation. Awarding certificates of land use rights and ownership of assets attached to land to the granted person.
+ In case of land division or land consolidation and there is a change of land user, the procedure for registering changes in land and assets attached to land shall be carried out according to regulations.
