HCMC announces 10 priority subjects for social housing rental

Ho Chi Minh City prioritizes 10 subjects who are allowed to rent social housing invested by the State with state budget capital.

The Ho Chi Minh City People's Committee has just issued Decision 47/2025/QD-UBND stipulating priority for subjects eligible to rent social housing invested and built by the State with public investment capital and standards, subjects, and conditions for buying, leasing, and renting social housing in Ho Chi Minh City.

This Decision details Point c, Clause 1, Article 37, Clause 6, Article 75 of Decree No. 100/2024/ND-CP dated July 26, 2024 of the Government detailing a number of articles of the Housing Law on the development and management of social housing.

According to the new regulations, Ho Chi Minh City prioritizes 10 groups of subjects eligible to rent social housing invested by the State with budget capital, arranged in the following order:

People with revolutionary contributions.

Relatives of martyrs.

People with disabilities.

People subject to resettlement in the form of buying or renting social housing.

Women.

Poor and near-poor households in rural areas.

Poor and near-poor households in rural areas are often affected by natural disasters and climate change.

Poor and near-poor households in urban areas.

Subjects recognized by competent authorities according to Clause 3, Article 3, Decree 73/2023/ND-CP.

Cadres, civil servants and public employees according to the provisions of law.

The Ho Chi Minh City Department of Construction or the housing management and operation unit, appointed by the Ho Chi Minh City People's Committee, will make a priority list for leasing without drawing lots. The approval is carried out in the above priority order until the number of available social housing is exhausted.

In case there are many dossiers in the same priority group, the next approval criteria will be based on the time of application submission.

If there are still many subjects at the same time submitting the application, the approval will be conducted through a draw. At that time, the Department of Construction is responsible for supervising the drawing process and making a record of the results to ensure publicity and transparency.

In addition to prioritizing tenants, the Ho Chi Minh City People's Committee also specifically stipulates the standards, subjects and conditions for buying, renting, and leasing social housing in the city.

Regarding standards, each individual or household is only allowed to buy or rent-purchase social housing once. This regulation applies to subjects under Clauses 1, 2, 3, 4, 5, 6, 8, 9 and 10, Article 76 of the Housing Law.

In particular, subjects under Clause 7, Article 76 of the Housing Law are allowed to rent only one social housing unit or one house for the People's Armed Forces at each time.

Regarding the subjects of buying, renting, or leasing social housing, it is stipulated in Article 76 of the Housing Law. Priority subjects and priority order are implemented according to regulations on renting social housing invested by the State with state budget capital.

Regarding the conditions for buying, renting, or leasing social housing, housing conditions apply according to the provisions of Point a, Clause 1, Article 78 of the Housing Law and Article 29 of Decree 100/2024/ND-CP.

Income conditions, for subjects under Clauses 2, 3, 4, Article 76 of the Housing Law, must be classified as poor and near-poor households according to the poverty standard of Ho Chi Minh City. Other subjects apply according to Point b, Clause 1, Article 78 of the Housing Law and Article 30 of Decree 100/2024/ND-CP.

In particular, social housing tenants are not required to meet the conditions for housing and income as the tenants who buy or rent a house.
