This content is mentioned in the draft new regulations of the Ho Chi Minh City People's Committee on compensation, support, and resettlement when the State recovers land in the city, which is currently being consulted by the Ho Chi Minh City Department of Agriculture and Environment.
According to the draft, for urban area construction investment projects, in case people's residential land is recovered, resettlement will be considered right within the project scope, according to Clause 7, Article 111 of the Land Law.
In addition, people whose residential land is recovered are considered for temporary housing rental costs if they are households, individuals permanently residing or temporarily residing in the house being cleared before the time of issuing the land recovery notice.
There are two forms of temporary residence support: Arranging temporary residence in the state-owned housing fund; supporting rent during the waiting period for resettlement arrangement.
The draft stipulates different levels of housing rent support, based on area and the number of people in the household.
Area 1 (former districts: 1, 3, 4, 5, 6, 7, 8, 10, 11, 12, Go Vap, Binh Thanh, Phu Nhuan, Tan Binh, Tan Phu, Binh Tan and Thu Duc City), households from 4 people or less are supported with 8 million VND/household/month; households from 5 people or more are supported with 2 million VND/person/month, total level not exceeding 24 million VND/household/month.
Area 2 (towns of districts and urbanized areas in previous districts such as Binh Chanh, Hoc Mon, Cu Chi, Nha Be, Can Gio), households from 4 people or less are supported with 7 million VND/household/month; households from 5 people or more are supported with 1.75 million VND/person/month, maximum 21 million VND/household/month.
Area 3 (communes belonging to previous districts: Binh Chanh, Hoc Mon, Cu Chi, Nha Be, Can Gio), households with 4 or less people are supported with 6 million VND/household/month; households with 5 or more people are supported with 1.5 million VND/person/month, total level not exceeding 18 million VND/household/month.
For previous cities of Binh Duong (Thuan An, Di An, Thu Dau Mot, Tan Uyen, Ben Cat), the similar support level for Zone 2 is 7 million VND/household/month for households up to 4 people; 1.75 million VND/person/month for households from 5 people or more, maximum 21 million VND/household/month.
The remaining districts of Binh Duong in the past and wards of Ba Ria - Vung Tau and Con Dao special zone apply a support level of 6 million VND/household/month for households up to 4 people; 1.5 million VND/person/month for households from 5 people or more, maximum 18 million VND/household/month.
For communes in the Ba Ria - Vung Tau area, households with 4 or less people are supported with 4 million VND/household/month; households with 5 or more people are supported with 1 million VND/person/month, with a total level not exceeding 12 million VND/household/month.

Temporary residence support time is calculated flexibly according to each specific case.
In cases where resettlement houses or land have not been handed over, people are supported with temporary accommodation from the time of handing over the land to receiving resettlement houses or land plots.
In case of resettlement using residential land, in addition to the above time, people are supported with an additional 6 months of temporary residence allowance to wait for complete house construction.
In case of handing over land 6 months earlier than the time of receiving resettlement land, people are supported with rent during the waiting time for house construction.
In case a part of the house is recovered but the remaining part does not meet living conditions, the compensation council will base on the construction scale to decide to support house rent, for a maximum of 6 months.
In case people cannot rebuild their houses due to project construction problems, the construction unit is responsible for paying rent during the obstruction construction period. After that, people continue to enjoy support amounts according to regulations.
