Based on Clause 1, Article 137 of the 2024 Land Law, Households and individuals who are using land stably and have one of the following types of documents established before October 15, 1993 are granted a Certificate of land use rights, ownership of assets attached to land (red book) and do not have to pay land use fees:
a) Documents on land use rights issued by competent authorities during the implementation of land policies of the Democratic Republic of Vietnam State, the Provisional Revolutionary Government of the Republic of South Vietnam and the Socialist Republic of Vietnam State;
b) One of the documents on land use rights issued by a competent authority under the old regime to land users, including: Land use right certificate; Property division document certified by an agency under the old regime; Document on buying and selling houses, donating houses, exchanging houses, inheriting houses attached to residential land certified by an agency under the old regime; Will or agreement on inheritance sharing of houses certified by an agency under the old regime; Permit to build houses; Architectural legalization permit issued by an agency under the old regime; Judgment of the Court under the old regime that has taken effect;
c) Temporary land use right certificate issued by a competent state agency or named in the Land Registration Book, Land Registration Book;
d) Documents of transfer of land use rights, purchase and sale of houses attached to residential land, now certified by the commune-level People's Committee to have used land before October 15, 1993;
e) Records of land use rights, land use right certificates made before December 18, 1980, with the name of the land user;
e) One of the documents prepared during the implementation of land registration according to Directive No. 299/TTg dated November 10, 1980 of the Prime Minister on measurement, classification and registration of land plots nationwide managed by state agencies that includes the name of the land user, including: Minutes of approval of the commune-level land registration council determining that the land user is legal; Summary of cases of legal land use prepared by the commune-level People's Committee or the commune-level Land Registration Council or the district-level or provincial land management agency; Application for land use right registration; Documents on certification of land use right registration issued by the commune-level, district-level or provincial People's Committee to land users;
g) Documents on declaration and registration of houses certified by the People's Committees of communes, districts or provinces, in which the land area with houses is recorded;
h) Documents of the national defense unit allocating land to officers and soldiers for housing according to Directive No. 282/CT-QP dated July 11, 1991 of the Minister of National Defense, where the land allocation is consistent with the land use plan for housing of officers and soldiers in the national defense land plan approved at the time of land allocation;
i) Projects or lists or documents on migration to build new economic zones, resettlement migration approved by the People's Committees of districts, provinces or competent agencies that include the name of the land user;
k) Documents containing content on the ownership of houses and works; documents on the construction and repair of houses and works certified or permitted by the People's Committees of districts, provinces or state management agencies on housing and construction;
l) Documents of temporary land allocation of the People's Committees of districts and provinces; Applications for land use approved and approved by the People's Committees of communes and agricultural cooperatives before July 1, 1980 or approved and approved by the People's Committees of districts and provinces;
m) Documents of competent state agencies on allocating land to agencies and organizations to allocate land for officials and employees to build their own houses or build houses to allocate or allocate to officials and employees with capital not belonging to the state budget or contributed by officials and employees to build;
n) Other papers on land use rights dated before October 15, 1993, prescribed by the Provincial People's Committee in accordance with local practice.
