The Inspectorate of Bac Ninh province has just issued a Notice of Inspection Conclusion at the Phu Khe Commune Residential Area Project, Tu Son Town (now Phu Khe Ward, Tu Son City).
The above project was implemented by Dai An Company Limited (Tu Son City, Bac Ninh Province) on a land area of 78,485.7 m2. Of which, there are 378 residential land lots.
The total investment is over 260 billion VND (including the winning auction price for land use rights of 196.725 billion VND, the construction of technical infrastructure is nearly 70 billion VND). Up to now, the project has been completed and put into use.
In addition to some achieved results, the inspection team pointed out many shortcomings and violations in the project in terms of construction planning, land acquisition, management and construction of works in the project. Specifically as:
The community's opinions on adjusting the detailed planning have not been ensured according to the prescribed order and procedures. This responsibility belongs to the Land Fund Development Center of Tu Son City.
The explanatory content does not have a complete assessment of fire prevention and fighting (PCCC), the responsibility belongs to the consulting unit, Dong Duong Construction Architecture Company Limited.
After adjusting the local planning of the auction project from 15 hectares to 7.8 hectares, the Tu Son City Land Fund Development Center did not publicly disclose the detailed adjusted planning. The Land Fund Development Center of Tu Son City also did not implement the marking of the planning project according to regulations.
The Tu Son City Urban Management Department, when appraised, did not detect some errors in the planning project such as incomplete content according to regulations on community consultation and assessment of fire prevention and fighting.
In addition, the Land Fund Development Center of Tu Son City, the People's Committee of Phu Khe Ward, and the People's Committee of Tu Son City have requested the Department of Natural Resources and Environment to advise the People's Committee of Bac Ninh province to allocate land for auction when compensation, support and relocation of matures on the land planned for auction have not been implemented.
During the construction process, Dai An Company was slow to approve the final settlement for additional investment capital to complete the project, affecting the progress and efficiency of capital use.
Tat Thang Company (construction unit) and the Management Board of Bac Ninh Urban Development Area supervised the acceptance of the construction in violation of regulations.
The inspection conclusion clearly stated that the violations and shortcomings had both objective and subjective causes.
In particular, the Land Fund Development Center of Tu Son City, the People's Committee of Phu Khe Ward, the People's Committee of Tu Son City, the Department of Natural Resources and Environment, the Urban Management Department, Dong Duong Construction Architecture Company Limited and Dai An Company did not implement and did not fully comply with the provisions of the law on planning, land and construction.
To remedy the consequences, the Provincial Inspectorate requested the People's Committee of Tu Son City to direct the Department of Economy, Infrastructure and Urban Areas to review, verify, and establish a record of administrative sanctions against Tat Thang Company, the Management Board of Bac Ninh Urban Development Area and Dai An Company in the construction and acceptance of the project.
At the same time, it recommended that the Heads of relevant agencies and units rectify state management and overcome limitations and violations.
Request the Tax Department of Region V to develop a plan to inspect and examine the tax content for the real estate transfer and business activities of Dai An Company.
