The Ministry of Education and Training announced the draft Circular Promulgating the Regulations on diplomas and certificates of the national education system to collect comments.
In particular, the revocation and cancellation of diplomas and certificates is clearly regulated in Article 16 of the draft Circular. Specifically as follows:
Article 16. Revoking or canceling diplomas and certificates:
1. Documents and certificates are revoked or canceled in the following cases:
a) Committing fraud in admission, study, exam, project protection, graduation thesis, thesis, thesis or fraud in making documents to be granted a certificate;
b) Awarded to unqualified people;
c) Issued by an unauthorized person;
d) Being erased or repaired;
d) For use by others;
e) Due to an error by the agency issuing the diploma or certificate.
2. The agency issuing the certificate or the agency managing the original book has the authority and responsibility to revoke or cancel the certificate.
3. The competent person issuing the certificate or certificate shall issue a decision to revoke or cancel the certificate or certificate and update the status of revocation or cancellation based on the database of the certificate or certificate.
The decision to revoke or cancel the diploma or certificate includes the following main contents:
a) full name, coffin, name; date of birth of the person with a diploma or certificate (recorded according to the issued diploma or certificate);
b) Name, number, date of year of issuance of the diploma or certificate; c) Reason for revocation or cancellation;
d) The effectiveness and responsibility for implementing the decision.
d) Information guiding the review of revoked or canceled diplomas and certificates.
4. The decision to revoke or cancel the degree or certificate must be posted on the electronic information portal of the competent authority to revoke or cancel the degree or certificate; sent to the person whose degree or certificate is revoked, the inspection agency that discovers the violation (if any), the agency where the degree or certificate is being revoked is working (if any) and relevant agencies and organizations.
