On September 9, the Department of Home Affairs of Lam Dong province said that the whole province has 320,083 people participating in social insurance as of the end of June 2026. However, the situation of late payment and evasion of social insurance, health insurance, and unemployment insurance still occurs in many units, mainly concentrated in enterprises.
One of the reasons is that some businesses face difficulties in production and business, lack capital sources, so they prioritize spending on other items. Notably, there are cases of using the 10.5% of social insurance money contributed by employees themselves into business capital instead of borrowing. When business operations are not effective, businesses lose financial balance, leading to late payment of social insurance, health insurance, and unemployment insurance.
The Department of Home Affairs assesses that the awareness of law compliance of some labor-using units is not high. Many businesses evade contributions for a long time but do not cooperate, avoid, do not sign debt repayment commitments or do not arrange people to work with the social insurance agency.
Deputy Director of Lam Dong Provincial Department of Home Affairs Le Thi Theu said that some units still do not cooperate in comparing the salary fund, do not pay debts, directly affecting the benefits of employees.
Notably, some businesses, although they have been inspected and examined many times, have not yet properly implemented the conclusions of functional agencies. Meanwhile, workers at some businesses have not boldly reflected and denounced acts of late payment and evasion of social insurance contributions because they are concerned about affecting jobs. This is also one of the factors that makes the prolonged debt situation not completely resolved.
The Department of Home Affairs believes that the regulations on suing enterprises for evading social insurance contributions are not really clear about the agency responsible for initiating lawsuits to protect workers' rights. Criminal handling of late payment and evasion of social insurance contributions is still difficult in determining the elements constituting a crime, so it has not created deterrence and spread.
Over the past time, functional agencies have strengthened inspection, examination, handling of administrative violations and resolving complaints and denunciations related to social insurance. Through inspection of the compliance with social insurance laws at 102 labor-using units, functional agencies requested units to prepare procedures and dossiers for registration to participate and supplement social insurance contribution time for 34 workers.
From July 1, 2025 to now, the locality has mediated 18 labor disputes, including cases related to social insurance and unemployment insurance policies.
In the process of reviewing and synchronizing data, functional agencies also discovered 8 cases of civil servants and public employees borrowing judicial records from others to study, work and pay social insurance. Among these, 3 cases are temporarily suspending monthly pension payments; 5 cases have submitted dossiers requesting settlement of retirement benefits but have not been resolved. The Social Insurance Agency has reported and is waiting for guidance from the Ministry of Home Affairs.
In the coming time, the Department of Home Affairs will strengthen inspection and supervision of the compliance with the law on social insurance; impose administrative penalties and transfer cases with signs of violations to functional agencies for investigation and handling.
The Department of Home Affairs also proposed not to consider honoring and rewarding; not to consider allowing participation in bidding and project investment for units that are late in paying or not participating in social insurance according to regulations. Notably, the Department of Home Affairs proposed to the National Assembly to supplement sanctions to temporarily postpone exits and freeze bank accounts for employers who evade payment and owe social insurance for a long time.
