1,011 billion VND in late payment of social insurance and unemployment insurance
Recently, in Dong Nai province, the situation of enterprises not registering to pay, not paying fully, late in paying, evasion of social insurance, health insurance, unemployment insurance (SI, HI, UBTN) has seriously affected the rights of employees.
According to the supervision conclusion of the Culture - Social Committee of the Dong Nai Provincial People's Council on the implementation of policies and laws on social insurance and unemployment insurance in the province, as of August 2025, there were more than 22,500 units participating in social insurance and unemployment insurance in the province, the number of people participating in compulsory social insurance was more than 1 million people, the number of people participating in unemployment insurance was more than 970,000 people and the number of people participating in voluntary social insurance was over 36,000 people.
The Culture - Social Committee of the Dong Nai Provincial People's Council said that the situation of late payment of social insurance and unemployment insurance is still high (1 1,011 billion VND) and there are 598 units that are unable to recover (cassessed assets, dissolved, owners flee, missing) with the amount of late payment of 134 billion VND.
According to the Trade Union Legal Consulting Center, Dong Nai Provincial Federation of Labor (abbreviated as the Center), in 2025, the Center will participate in a series of labor cases to protect the rights of employees, the most of which are cases related to social insurance debts, accounting for 90% of cases where the Center participates in supporting employees. In the past, the Center has supported workers in filing and participating in the prosecution of 94 labor cases at a court in Ho Chi Minh City over the lawsuit against a company that owes social insurance and more than 20 cases in a court in Dong Nai province.
Mr. Vu Ngoc Ha - Director of the Trade Union Legal Consulting Center - said: Enterprises that are late in paying social insurance cause great difficulties for employees such as: Not being able to retire, not being able to settle maternity sickness regimes, and disadvantaged employees' rights.

The Culture - Social Committee of the Dong Nai Provincial People's Council also pointed out that controlling the employment situation of workers is not effective, there are also cases of workers receiving unemployment benefits while having jobs.
According to the report, the total number of beneficiaries of unemployment benefits that must be recovered is more than 10,017, 8,362 people have been recovered with a budget of nearly 46 billion VND, while 1,655 people with more than 8.7 billion VND have not been recovered. At the same time, there is currently no specific document guiding the recovery process, leading to confusion in implementation.
From the above situation, the Department of Culture and Social Affairs of the People's Council of Dong Nai province recommends that Dong Nai Social Insurance organize flexible inspection and handling of enterprises that have not registered to pay, pay incompletely, are late in paying, or evade paying social insurance, health insurance, and unemployment insurance to promptly recover late payment, evasion of payment, and expenses that violate regulations on social insurance, health insurance, and unemployment insurance; resolutely handle and propose handling of violations, advise the Steering Committee to implement social insurance, health insurance, and unemployment insurance policies on solutions for each group of violations; prepare a file to propose prosecution according to the provisions of the Penal Code and relevant legal provisions for enterprises that have evaded social insurance, health insurance, and unemployment insurance.
At the same time, it is recommended that the Department of Home Affairs coordinate with the provincial Social Insurance and related units to strengthen inspection of compliance with the provisions of the law on social insurance and unemployment insurance; regularly review and handle according to regulations for enterprises that have not participated or have not fully participated in social insurance and unemployment insurance for employees...
In response to the proposal of the Provincial People's Council's Committee on Culture and Society, the Chairman of the Provincial People's Committee directed and assigned the Department of Home Affairs, the Department of Finance, the Department of Science and Technology, the Department of Health, and the Provincial Social Insurance, according to their assigned functions and tasks, to study the proposal of the Provincial People's Committee on Culture and Society, and organize implementation in accordance with regulations. For content beyond the authority, report and advise the Provincial People's Committee to consider. Assign the Department of Finance, the Department of Science and Technology, the Department of Health, and the Provincial Social Insurance to report to the Provincial People's Committee (through the Department of Home Affairs) the implementation results before February 25, 2026.
