Mr. Nguyen Van Cong (name has been changed) has been a professional contract employee at a public unit since January 2015 (salary grade 01.003, level 1).
In March 2021, he was recruited as a civil servant. According to the recruitment decision, he was exempted from probation and was appointed and paid at the specialist level, level 2, with the next salary increase reserved from January 15, 2019.
From January 2015 to July 2024, he held the equivalent position for 6 years and 2 months and the specialist position for 3 years and 6 months. The total time is 9 years and 8 months.
However, according to the recruitment decision, his next salary increase (3rd time) will be from January 15, 2019, which means 1 year of probationary period will be deducted without salary increase consideration.
"In my case, if I am exempted from probation, will my probationary period be deducted by 1 year without being considered for a salary increase as above?
According to the provisions of Clause 5, Article 6 of Circular 02/2021/TT-BNV dated June 11, 2021 of the Ministry of Home Affairs, is my case eligible for the time holding the specialist rank and equivalent to take the exam to be promoted to the senior specialist rank?" - Mr. Cong wondered.
Regarding the reflection and recommendation of Mr. Nguyen Van Cong, the Ministry of Home Affairs said: According to the provisions of Point c, Clause 1, Article 2 of Circular No. 08/2013/TT-BNV (supplemented in Clause 3, Article 1 of Circular No. 03/2021/TT-BNV), the probationary period (including the case of receiving 100% of the salary of the probationary civil servant category) is not counted for consideration of regular salary increase.
According to the provisions of Point d, Clause 3, Article 30 of Decree No. 138/2020/ND-CP, in case a civil servant, before being recruited or accepted, has worked for a period of time with compulsory social insurance payment in accordance with the provisions of the Law on Social Insurance, working in a position with appropriate professional qualifications (if the working period is not continuous and has not received a one-time social insurance subsidy, it will be accumulated) and that period is calculated by the competent authority as the basis for salary classification in the current civil servant rank, it will be considered equivalent to the current civil servant rank.
