Youme Law Firm LLC said that according to Clause 1.23, Section 5 of the Project attached to Decision 759/QD-TTg of the Prime Minister in 2025, the arrangement of staff for commune-level civil servants and public employees is regulated as follows:
Due to the larger scale of commune-level administrative units than at present and the increased tasks and powers of local authorities at the commune level (implementing all tasks and powers of local authorities at the district and commune levels today). Accordingly, the Government plans to pay the staff of commune-level civil servants and public employees according to the following orientation:
- In the immediate future, the number of cadres, civil servants and public employees of the district and commune -level officials and public employees is arranged before the arrangement to arrange for new commune -level administrative units (after arrangement).
Implement the review and streamlining of staff in conjunction with restructuring and improving the quality of the team of commune-level cadres, civil servants and public employees to meet the requirements of the tasks, ensuring a period of 5 years basically in accordance with regulations.
The Ministry of Home Affairs is assigned to coordinate with the Central Organizing Committee and relevant agencies based on the population size, natural area, functions, tasks, and powers of local authorities at the commune level as a basis for developing and completing job positions to submit to competent authorities to assign the payroll of commune-level cadres, civil servants, and public employees to localities.
- End the use of non-professional workers at the commune level; assign local authorities to consider and arrange non-professional workers at the commune level to meet the requirements of the task of participating in work in villages and residential groups; implement the policy of resignation for non-professional workers at the commune level without being assigned to work according to regulations.
- Based on the population size, natural area, socio -economic development level of communal administrative units, the Government oriented the assignment of the total payroll of the local authorities to the localities to localities (is expected to an average of about 32 payrolls/1 commune level). On that basis, assigning the provincial local authorities to decide the number of payrolls for local authorities of each commune administrative unit in the area to suit practical requirements.
