YouMe Law Company Limited said: Based on Clause 2, Article 39 of the 2025 Employment Law stipulating the benefit level, benefit period, benefit time and dossier, order, procedures for receiving unemployment benefits:
1. The monthly unemployment benefit level is equal to 60% of the average monthly salary for unemployment insurance contributions of the last 6 months of unemployment insurance contributions before the termination of labor contracts, work contracts or termination of work, but not exceeding 05 times the regional minimum monthly salary announced by the Government, which is applied in the last month of unemployment insurance contributions.
2. The period of enjoying unemployment benefits is calculated according to the number of months of unemployment insurance contribution, for every contribution of 12 months to 36 months, 3 months of unemployment benefits are entitled, then, for every additional 12 months of contribution, 1 month of unemployment benefits are entitled, but the maximum period of enjoying unemployment benefits is 12 months.
3. The time to receive unemployment benefits is the 11th working day from the date of submitting complete dossiers for unemployment benefits.
4. Employees who are receiving unemployment benefits are entitled to health insurance benefits according to the provisions of the law on health insurance, including the period of temporary suspension of unemployment benefits according to the provisions of Clause 2, Article 41 of this Law. Employees who are receiving unemployment benefits are paid health insurance by the social insurance agency from the Unemployment Insurance Fund.
5. The Government shall specify Clauses 1 and 2 of this Article; stipulate dossiers, order, and procedures for enjoying unemployment benefits.
Accordingly, the time to receive unemployment benefits is calculated based on the number of months of unemployment insurance contribution.
Just pay for 12 months to 36 months and you will receive 3 months of unemployment benefits.
After that, if you pay for 12 more months, you will receive an additional month of unemployment benefits.
However, the maximum period for receiving unemployment benefits is 12 months.
The time to receive unemployment benefits is the 11th working day from the date of submitting complete dossiers for unemployment benefits.
