Article 26 of the 2025 Law on Teachers stipulates as follows:
Retirement regime for teachers
1. The retirement age of teachers is implemented according to the provisions of the Labor Code and other relevant legal provisions, except for the cases specified in Clause 2 of this Article and Article 27 of this Law.
2. Teachers in preschool education institutions, if they wish, can retire at a lower age than the retirement age of workers under normal conditions but not more than 5 years old. In case of having paid social insurance for 15 years or more, the pension percentage due to early retirement will not be reduced.
Article 4 of Decree 135/2020/ND-CP stipulates the retirement age under normal working conditions as follows:
The retirement age of employees in normal working conditions according to Clause 2, Article 169 of the Labor Code is specifically regulated as follows:
(1) From January 1, 2021, the retirement age of employees in normal working conditions is 60 years and 3 months for male employees and 55 years and 4 months for female employees; then, increase by 3 months each year for male employees until reaching the age of 62 in 2028 and increase by 4 months each year for female employees until reaching the age of 60 in 2035.
Based on the roadmap for adjusting the retirement age of workers in Decree 135/2020/ND-CP, for female teachers in normal working conditions, the retirement age in 2026 will be 57 years old.
In addition, according to Clause 2, Article 26 of the 2025 Law on Teachers, teachers in preschools, if they wish, can retire at a lower age than the retirement age of employees under normal conditions but not more than 5 years. Reversal
In addition, teachers who are teachers are also eligible for early retirement in some cases in Clause 2, Article 27 of the 2025 Law on Teachers as follows:
- Not more than 5 years old for teachers with a doctorate degree;
- Not more than 7 years old for teachers with the title of associate professor;
- Not more than 10 years old for teachers with the title of professor.
