On September 4, the People's Court of Region 12 - Ho Chi Minh City opened a trial of the dispute over compensation for damages caused by work-related accidents between the plaintiff, Mr. Ho Thanh Thinh (born in 1995) and the defendant, Pomina 2 Steel Joint Stock Company (abbreviated as Pomina 2 Company).
Mr. Nguyen Trung Ngan (Department of Legal Policy and Labor Relations of the Ho Chi Minh City Labor Federation) was assigned to participate in the trial to protect the legitimate rights and interests of workers.
According to the case file, on August 18, 2022, while working at the Pomina 2 Company factory, Mr. Thinh had a work accident when a hot steel bar was cut through his thigh in the left knee area, completely severing the thigh nerve, the muscles behind the thighs... the disability rate was assessed at 46%.
However, realizing that the company had not fully implemented the regime for employees, Mr. Thinh filed a lawsuit, requesting compensation for medical expenses (including arising treatment costs, physical therapy costs, hiring caregivers) for a total of 36.8 million VND; compensation for occupational accidents in the amount of 159 million VND, and interest arising according to regulations.
At the trial, the company's representative agreed to pay for additional arising treatment costs and physical therapy costs, but did not agree to other requests. The business side believes that the cost of hiring caregivers (about 12 million VND/2 months) is not appropriate, without full documents...
Due to the long questioning period to clarify the amounts of money that the enterprise has paid to the employees, as well as the evidence that the employees requested compensation, the Trial Council decided to postpone the trial, and will continue the trial on the afternoon of September 5.
