On the Government Portal, Ms. P.T.T.H in Ho Chi Minh City shared that she and her brother are children of martyrs. Her brother is preparing to register to buy social housing.
Ms. H researched but did not find any regulations on income conditions for subjects mentioned in Clause 1, Article 76 of the Housing Law 2023.
She asked, if her brother does not have a labor contract, does he have to confirm the income conditions according to Form No. 05? Does her sister-in-law need to confirm her income conditions (her sister-in-law also does not have a labor contract)?
The Ministry of Construction responds to this issue as follows:
Clause 1, Article 76 of the 2023 Housing Law stipulates that the beneficiaries of social housing support policies are:
"People with revolutionary contributions and relatives of martyrs are eligible for support for housing improvement according to the provisions of the Ordinance on Incentives for People with Revolutionary contributions".
At Point a, Clause 1, Article 78 of the 2023 Housing Law, it is stipulated that in addition to being a beneficiary of a housing support policy, a person who is a relative of a martyr when purchasing a social housing must also meet housing requirements, and must ensure the principle of implementing the housing support policy as prescribed in Point d, Clause 1, Article 79 of the 2023 Housing Law, without stipulating income conditions.
