The Ho Chi Minh City People's Committee has just issued a Regulation on coordination in initially resolving strikes that are not in accordance with labor laws in the city.
According to this regulation, the Chairman of the People's Committee of the commune, ward, and special zone of Con Dao presides over the establishment of a working group to initially resolve collective labor disputes and strikes that are not in accordance with labor law occurring at enterprises located in the management area.
The leader of the People's Committee of the commune, ward, and special zone of Con Dao is the head of the working group. The members include: Head of the Department of Culture - Social Affairs, representatives of the management team according to the management decentralization of the City Labor Federation, trade unions, police leaders, labor conciliators, representatives of the Construction Committee of the Party Committee of the commune, ward, Con Dao special zone, Chairmen of the Association of enterprises of communes, wards, Con Dao special zone where the enterprise resides, representatives of the Social Insurance.
Based on the nature and scale of the strike if necessary, the Chairman of the People's Committee of the commune, ward, and special zone of Con Dao can propose a number of departments and branches to join the working group.
The working group is responsible for stabilizing security and order at enterprises and areas where enterprises operate, causing collective labor disputes, mass strikes; guiding, explaining and requiring labor dispute parties to properly fulfill their rights, responsibilities and obligations according to the provisions of the law on labor; recording the requests and recommendations of the labor dispute parties
The working group also recommended solutions to help the parties in the labor dispute negotiate agreements in the spirit of quickly stabilizing production and business to protect the legitimate rights and interests of employees and employers.
During the settlement process, if one of the disputants is found to have violated the law, the working group leader shall make a record to handle or recommend the competent authority to handle the individual or organization that committed the violation according to the provisions of law.
