Seasonal workers reflect being forced by the company to quit their jobs to not pay the 13th month bonus

Ho Chi Minh City - Seasonal workers of a company in Bau Bang commune reflected that they were forced by the company to quit their jobs to not pay the 13th month bonus.

Reflecting to Lao Dong Newspaper, Mr. N.V.T (a seasonal worker working at Ampacs International Co., Ltd. in Bau Bang Industrial Park, Bau Bang commune, Ho Chi Minh City) said that he was forced by the company to quit his job to not pay the 13th month bonus.

According to Mr. N.V.T, Ampacs International Co., Ltd. promised to pay the 13th month salary by Tet to have more income to cover living expenses. However, approaching the 13th month salary payment time, the company asked seasonal workers to write resignation letters and not pay the 13th month bonus. "We look forward to this additional bonus to have money to go home and cover living expenses. However, the company's reduction of this benefit makes us very sad and face difficulties" - Mr. N.V.T shared.

On February 6, Lao Dong Newspaper reporters worked with Ms. Tran Thi My Nhien - assistant to the Chairman of the Company and Chairman of the Grassroots Trade Union (CĐCS) of Ampacs International Co., Ltd.

According to Ms. Tran Thi My Nhien, when there was information above, the grassroots trade union worked with the company's leaders and related departments to ensure the rights of employees.

According to Ms. Tran Thi My Nhien, the company currently has about over 2,500 full-time workers and over 1,600 seasonal workers. The use of seasonal workers reveals many issues regarding workers' rights. For example, there is a policy that the company pays for workers but cannot control whether the supply unit pays for workers or not. Therefore, recently, the company has implemented the conversion of seasonal workers to full-time workers so that workers can fully enjoy regimes and benefits.

The company and the grassroots trade union met with employees to propagate that when officially entering, they will enjoy many benefits and policies of the company. As a result, out of over 1,600 seasonal workers, 801 people agreed to transfer to official positions, 253 people disagreed and the rest did not have any opinions.

Regarding the 13th month bonus, all official contract workers are rewarded, only a part of seasonal workers are not awarded the 13th month salary bonus because they do not agree to officially join.

According to the company's regulations, employees must work until February 13th to enjoy the 13th month. If employees do not agree to sign an official contract, then considering the rights and obligations between the two parties, the company will notify the supplier to relocate employees to work in another project, within 3 days. At this time, if that employee does not work at the company until February 13th, they will not receive the 13th month salary. If employees agree to work officially, they will still receive bonuses" - Ms. Tran Thi My Nhien said.

Ms. Tran Thi My Nhien - Chairwoman of the Trade Union of Ampacs International Co., Ltd. - added that the unit is proposing to the company's leaders to consider whether it is possible to still pay the 13th month bonus to seasonal workers or not. Currently, the company's leaders are considering this issue.
