Article 17 of the Law on Public Employees 2025 (effective from July 1, 2026) stipulates as follows:
Public employee recruitment method
1. The recruitment of public employees is carried out through the following method:
a) Recruitment exam;
b) Admission for each group of subjects according to the Government's regulations.
2. In addition to the recruitment method as prescribed in Clause 1 of this Article, the following subjects, if they immediately meet the requirements of the job position, will be recruited as civil servants:
a) Experts, scientists, people with special talents and abilities, people with appropriate experience;
b) People who are signing contracts to work at public non-business units;
c) Other subjects according to the provisions of law on industries and fields.
3. For people who are current cadres, civil servants, public employees, salaried people in the People's Army, People's Police, and basic organizations, if they meet the standards and conditions of the job position and are agreed by the competent agency or unit to be transferred by writing to become public employees in public non-business units, they are not required to implement the recruitment regulations in Clauses 1 and 2 of this Article.
4. The Government shall specify this Article.
Accordingly, the following subjects are admitted to become civil servants without recruitment if they immediately meet the requirements of the job position:
+ Experts, scientists, people with special talents and abilities, people with suitable experience;
+ People who are signing contracts to work at public non-business units;
+ Other subjects according to the provisions of law on industries and fields.
