Mr. Nguyen Van Quang (character's name has been changed) said that he is currently a civil servant working at a provincial-level public service unit.
He was recruited to the payroll in 2006 with the position of officer; in 2012, after obtaining a degree in information technology, he was transferred to the position of specialist.
According to Mr. Quang, during his working career, he was mainly in charge of the fields of network governance, system governance, programming and digitalization at the agency.
After implementing the two-level government arrangement, he wished to work at the commune level, in the context of the locality lacking personnel in charge of information technology.
Referring to the provisions of Decree No. 170/2025/ND-CP, Mr. Quang said that he fully meets the conditions for working time of 5 years or more, works in the right profession, and has paid compulsory social insurance according to regulations.
From there, he raised the issue: In case he is accepted to work in the commune, does he have to take the exam or take the entrance exam from a civil servant to a civil servant or not.
He also was concerned about the provisions at Point b, Clause 2, Article 14 of Decree 170/2025/ND-CP, which clearly stated that an Inspection and Examination Council was not established for cases accepted under Point b, Clause c, Clause 1, Article 13, who did not hold leadership or management positions.
Therefore, Mr. Quang hopes to clarify whether acceptance in his case means being considered for direct transfer from a civil servant to a commune-level civil servant or still having to undergo an exam or examination according to regulations.
Regarding Mr. Quang's reflection on the proposal, the Ministry of Home Affairs responded on the Electronic Information Portal.
The Ministry of Home Affairs said that Clause 2, Article 14 of Decree No. 170/2025/ND-CP dated June 30, 2025 of the Government regulating the recruitment, use and management of civil servants stipulates the establishment of an Examination Council to accept in cases specified in Points b, c and dd, Clause 1, Article 13 civil servants who do not hold management leadership positions.
Pursuant to the provisions of Article 67 of Decree No. 170/2025/ND-CP, the Ministry of Home Affairs requests that he discuss with the competent authority recruiting civil servants where he is recruited for consideration.
