Decree 170/2025/ND-CP effective from July 1, 2025 stipulates the conditions and standards for civil servants when changing job positions as follows:
1. For leadership and management positions, they are implemented according to the decision of the competent authority on personnel work.
2. For professional and technical job positions and support and service job positions
a) The job position is consistent with the ratio of civil servants who need to be arranged according to the job position in the civil servant-using agency approved by competent authorities;
b) classified as having completed their tasks well or better in the year of work immediately preceding the year of job change; not being subject to disciplinary action; not being subject to disciplinary action; not being subject to prosecution, investigation, prosecution, trial; not being subject to disciplinary action regulations according to Party regulations and law;
c) Having the results of performing the task demonstrated through the quantity, quality and progress of the product at the job position taken up in accordance with the expected job position;
d) Have sufficient capacity, professional qualifications, and skills as required in the job description and job position capacity framework expected to be arranged.
3. The head of the agency employing civil servants is responsible for developing a plan to change the job position of civil servants under his/her management, reporting to the head of the agency managing civil servants for decision. The content of the job change plan includes:
a) Total assigned positions, total present positions;
b) The ratio of civil servants to be arranged according to each job position in an agency employing civil servants has been approved by competent authorities; the number of civil servants currently available according to each job position;
c) Results according to annual assessment and classification, results of regular monitoring and assessment of civil servants expected to be assigned to new job positions;
d) Number of civil servants who meet the conditions for being assigned to new job positions;
d) Optional options if there is a balance.
