Proposal to supplement regulations on civil servant ranks according to job positions

The Ministry of Home Affairs proposes to add a section regulating the arrangement and change of job positions, and the classification of civil servants according to job positions.

The Ministry of Home Affairs is seeking opinions on the draft Decree on Regulations on recruitment, use and management of civil servants. This will be a document replacing Decree No. 138 of 2020 of the Government (amended and supplemented in Decree No. 116 of 2024).

According to the draft submission, the Ministry of Home Affairs proposed to add a section on regulations on the arrangement and change of job positions, and the arrangement of civil servant ranks according to job positions.

The draft stipulates: Arrangement of job positions and civil servant ranks for those who are recruited as civil servants; Cases of job change;

Change the job position with a civil servant rank rank higher than the current rank and change the job position with a civil servant rank lower than the current rank.

According to the Ministry of Home Affairs, the addition of this section aims to determine specific roles and tasks in arranging job positions and civil servant ranks for those who are recruited as civil servants.

At the same time, the draft decree also outlines the responsibility of the head of the agency employing civil servants assigning work in accordance with the requirements of recruitment and training positions, monitoring and evaluating the performance of duties and tasks of civil servants.

The Ministry of Home Affairs said that the above contents aim to regulate cases of job position changes being ranked accordingly with a higher professional or technical rank than the current job position or cases of being assigned to lower job positions due to not meeting the requirements of the task.

Thereby, to determine the responsibility of the head of the agency employing civil servants in developing a specific plan as a basis for reviewing and making a list of civil servants who meet the standards and conditions for changing job positions with civil servant ranks ranked higher in professional and technical fields than the current civil servant rank.

This content is amended and supplemented in accordance with the spirit of the draft Law on Cadres and Civil Servants being considered and approved by the National Assembly.
