Clause 5, Article 29 of Decree 170/2025/ND-CP (effective from July 1, 2025) stipulates as follows:
Standards and conditions for appointment

5. Conditions on appointment age:
a) Civil servants proposed for first appointment to a position or title of leader or manager or proposed for appointment to a higher position or title of leader or manager must be of age to work for the full term of appointment. The time to calculate the age of appointment is implemented according to the regulations of competent authorities. Special cases shall be considered and decided by competent authorities;
b) Civil servants appointed to hold new positions or titles equivalent to or lower than the current position or title shall not be counted for the age of appointment as prescribed in Point a of this Clause.
Thus, according to the above regulations, the age for appointing civil servants in leadership and management positions must meet the following conditions:
Civil servants who are proposed to be appointed for the first time to hold a leadership or management position or position or position are proposed to hold a higher leadership or management position or position, must be of age to work for the full appointment term.
The time to calculate the age of appointment is implemented according to the regulations of competent authorities. Special cases are considered and decided by competent authorities.
In case a civil servant is appointed to a new position or title equivalent to or lower than the current position or title, the age of appointment shall not be calculated according to the above regulations.
