OPEN LETTER
The 14th Vietnam Trade Union Congress, term 2026 - 2031 is an important political event, marking a new step in the development of the working class and the Vietnam Trade Union organization in the new era of national development.
To make the draft Charter of the Vietnam General Confederation of Labour truly a product of the intelligence, enthusiasm, and responsibility of officials, union members, and workers nationwide; and at the same time meet the requirements of renovating the organization and activities of trade unions in the new situation, the Executive Committee of the Vietnam General Confederation of Labour respectfully wishes to receive many valuable and enthusiastic comments from generations of trade union officials, union members, workers and the entire People on the draft Charter of the Vietnam General Confederation of Labour submitted to the 14th Vietnam General Confederation of Labour Congress.
The draft Charter is posted on the Electronic Information Portal of the Vietnam Trade Union organization at the address: congdoanvietnam.vn, and also posted on the official website of Lao Dong Newspaper. Time to receive comments: until May 31, 2026.

PREMONITION
The Vietnam Trade Union, formerly the Red General Confederation of Labor of Tonkin, was established on July 28, 1929.
The Vietnam Trade Union is a large socio-political organization of the working class and of workers, voluntarily established by workers, with the aim of gathering and uniting forces, building a modern and strong Vietnamese working class; representing, caring for and protecting the legitimate and lawful rights and interests of union members and workers; being the sole representative of workers at the national level in labor relations and international relations on trade unions; participating in state management, socio-economic management; supervising, social criticism, participating in inspection, examination, and supervision of the activities of state agencies, organizations, units, and enterprises on issues related to the rights and obligations of workers; propagating and mobilizing workers to study, improve their qualifications and professional skills, comply with the law, build and protect the Fatherland.
The Vietnam Trade Union has the class nature of the working class and the mass nature, is a member of the political system directly under the Vietnam Fatherland Front led by the Communist Party of Vietnam, has cooperative relations with the State, coordinates with socio-political organizations and other social organizations; operates within the framework of the Constitution and laws of the Socialist Republic of Vietnam.
The Vietnam Trade Union is loyal to the interests of the working class, always associated with national and ethnic interests, maintaining and promoting the tradition of international solidarity, for peace, national independence, democracy and social progress.
Chapter I
TRADE UNION MEMBER
Article 1. Subjects, conditions, procedures for joining the Vietnam Trade Union and transferring trade union membership
1. Subjects joining the Vietnam Trade Union
a) Workers who are Vietnamese citizens working in organizations, units, enterprises, cooperatives, cooperative unions (collectively referred to as units, enterprises) and households, individuals using labor in accordance with the law; people working without labor relations on Vietnamese territory.
b) Workers who are foreign citizens working in Vietnam under labor contracts with a term of 12 months or more.
2. Conditions for joining the Vietnam Trade Union
a) Compliance with the Constitution and laws of Vietnam;
b) Approving the Charter of the Vietnam Trade Union;
c) Voluntary joining the Vietnam Trade Union;
d) Not being an organizational member of employees at the enterprise.
3. The procedure for joining the Vietnam Trade Union is carried out according to the guidance of the Standing Committee of the Vietnam General Confederation of Labor.
4. When changing workplace, union members are responsible for reporting to the trade union executive committee where they move to and where they move to to carry out procedures for transferring trade union activities.
Article 2. Rights and obligations of trade union members
1. Rights of union members
a) Being allowed to join and participate in trade union activities according to the provisions of the Charter of the Vietnam Trade Union.
b) Be required for the trade union to represent and protect legitimate and lawful rights and interests when violated. Proposing to the trade union organization to propose to competent organizations and individuals to implement regimes, policies, and laws for employees.
c) Be informed, discussed, proposed, and voted on the work of the trade union organization, election of the leadership agency of the trade union organization, questioning trade union leaders; evaluating the operating results of grassroots trade union officials; proposing disciplinary action against trade union officials with violations.
d) Trade union members who are Vietnamese citizens are allowed to participate in the establishment of grassroots-level trade unions, are allowed to nominate and nominate leadership agencies of trade union organizations, and outstanding trade union members are introduced for Party fostering, consideration, and admission.
d) Being propagated and disseminated the Party's guidelines and policies, the State's policies and laws related to trade unions, employees and Trade Union regulations.
e) Be guided, consulted, and provided with free legal support by the trade union on labor law, trade union law, employment law, social insurance, unemployment insurance, health insurance, occupational safety and health, law on cadres, civil servants, public employees; be represented by the trade union to participate in legal proceedings in labor cases to protect legitimate and lawful rights and interests in accordance with the law.
g) Be visited and supported by the trade union in case of illness, maternity, difficulties, hardships and enjoy activities of care, welfare, social security policies, social housing policies, and preferential treatment of the trade union organization implemented by the Trade Union; participate in cultural, sports, sightseeing, and tourism activities organized or jointly organized by the trade union; be consulted, guided, and supported by the trade union in finding jobs, vocational training, improving professional qualifications, nghiệp vụ, and professional skills, and be able to use electronic applications of the Vietnam Trade Union, accessing Trade Union digital data as prescribed.
h) Being commended and rewarded for achievements in labor, production and trade union activities.
i) Being temporarily suspended from trade union activities and not having to pay union dues when having their labor contracts, working contracts temporarily suspended or losing their jobs; union members in particularly difficult circumstances are considered for exemption or reduction of union dues.
k) Retired union members, if they continue to work under labor contracts and wish to do so, will be considered by the grassroots trade union executive committee, grassroots professional union to continue to be union members.
2. Responsibilities of union members
a) Comply with the Constitution and laws of the Socialist Republic of Vietnam; implement the Charter of the Vietnam Trade Union, resolutions of trade unions at all levels, participate in trade union activities and activities, and pay union dues as prescribed.
b) Constantly learn and improve political, cultural, professional, nghiệp vụ, and vocational skills; working style, and cultivate the qualities of the working class.
c) Unite and help comrades and colleagues in labor and in life; protect the legitimate and lawful rights and interests of union members, workers and trade union organizations; constantly improve productivity, quality, and labor efficiency; participate in building strong units and enterprises.
d) Propagating and mobilizing workers to join the Vietnam Trade Union and participate in building a strong trade union organization.
e) Participate in building progressive, harmonious and stable labor relations.
Chapter II
TRADE UNION OFFICIALS
Article 3. Trade union officials
1. Trade union officials who are Vietnamese citizens holding positions from deputy heads of trade union groups or higher through elections at trade union congresses or conferences, are recognized, appointed, assigned, recruited, and appointed by competent authorities to trade union official positions or are assigned regular tasks to perform the functions and tasks of the trade union organization.
2. Trade union officials include full-time trade union officials and non-full-time trade union officials.
a) Full-time trade union officials are people who are elected, recruited, appointed, and appointed to regularly undertake work in the Trade Union organization.
b) Non-specialized trade union officials who are elected by trade unions at all levels or competent authorities of the Trade Union to be appointed to positions from deputy head of the trade union group or higher to concurrently perform the work of the Trade Union organization.
3. Trade union officials loyal to the Fatherland, to the Vietnam Trade Union and the Vietnamese working class, wholeheartedly serving union members and workers, strictly implementing the Party's guidelines and policies, the State's policies and laws and the Charter of the Vietnam Trade Union, having qualifications, capacity, and skills to mobilize workers, having health, prestige, bravery, and enthusiasm to perform the tasks of trade union officials.
4. Trade union officials working at units and enterprises, if they meet the conditions on qualifications, capacity, standards, and prestige according to the regulations of the Party, State and Vietnam General Confederation of Labor, can be recruited, transferred, received, and arranged to do suitable work in the Trade Union organization.
5. Dismissal and resignation of trade union officials
a) Trade union officials who do not meet work requirements, have reduced prestige, have violations but have not reached the level of disciplinary dismissal, the competent authority shall consider and decide to dismiss them.
b) Trade union officials who voluntarily resign from their positions, the competent authority shall consider and approve their resignation.
Article 4. Responsibilities and powers of trade union officials
1. Responsibilities of trade union officials
a) Implementing the provisions of law to represent and protect the legitimate and lawful rights and interests of union members, workers, and collective workers.
b) Maintain close contact with union members and workers; listen to opinions and recommendations of union members and workers to resolve, advise or report and reflect promptly to competent organizations and individuals for consideration and resolution.
c) Propagating and mobilizing union members and workers to well fulfill their civic obligations; comply with the Party's guidelines and policies, the State's policies and laws, and the internal regulations and rules of units and enterprises; constantly learn and improve political, legal, cultural, professional, and vocational skills; cultivate qualities, working style, sense of responsibility, class consciousness, and national pride and self-esteem.
d) Set an example in all aspects for union members and workers; actively protect the regime, protect the Party and the Vietnam Trade Union organization.
e) Developing and managing union members and building strong trade union organizations; mobilizing, attracting, and gathering members and organizations of employees at enterprises to join the Vietnam Trade Union.
e) Fight against manifestations and acts of violating the Party's guidelines, policies, resolutions, policies, laws of the State and resolutions and regulations of trade unions at all levels.
g) Manage and use the finances and assets of the trade union organization in accordance with regulations.
h) Perform other tasks assigned by the trade union organization.
2. Powers of trade union officials
a) Being a legal or authorized representative, protecting the legitimate and lawful rights and interests of union members, employees, and collective employees.
b) To exercise the rights of trade union officials in accordance with the Party's regulations, the State's laws and the regulations of the Vietnam General Confederation of Labor.
c) Be guaranteed conditions for trade union activities at the workplace according to the provisions of law and the Vietnam General Confederation of Labor.
d) Be protected when being discriminated against for reasons of joining or participating in trade union activities; be helped and supported in the process of performing tasks.
d) Being trained and fostered to improve professional skills and trade union work.
e) To enjoy regimes and policies according to the regulations of the Party, State and Trade Union organization.
Chapter III
PRINCIPLES OF ORGANIZATION AND OPERATION OF THE VIETNAM GENERAL CONFEDERATION OF LABOUR
Article 5. Principles of organization and operation
1. The Vietnam Trade Union is established on a voluntary basis; organized and operated according to the principle of democratic centralism, trade union leadership agencies at all levels are established by election, implemented by collective leadership, individual in charge, minorities submit to the majority, subordinates submit to superiors, individuals submit to organizations; cooperate and coordinate with employers, while ensuring the independence of the Trade Union organization.
2. The highest leadership body of the Vietnam Trade Union is the National Congress of the Vietnam Trade Union (Vietnam Trade Union Congress). The leadership body at each level of trade union is the trade union congress of that level. The leadership body of each level of trade union between two congresses is the executive committee.
3. Resolutions of trade unions at all levels are passed by a majority and must be strictly implemented.
4. The Vietnam Trade Union, together with other member organizations of the Fatherland Front, negotiate democratically, coordinate and unify actions chaired by the Vietnam Fatherland Front, and at the same time promote the proactiveness and creativity of the trade union organization, implementing according to the Constitution, laws, the Charter of the Vietnam Fatherland Front and the Charter of the Vietnam Trade Union.
Article 6: Badges, Flags, traditional songs of the Vietnam Trade Union
Badges, Flags, and Traditional Songs of the Vietnam Trade Union are used uniformly in official activities of trade union levels and units and enterprises under the Vietnam Trade Union organization.
Article 7. Vietnam Trade Union Organization System
The Vietnam Trade Union is a unified organization consisting of the following levels:
1. Central level: Vietnam General Confederation of Labor.
2. Upper-level grassroots trade unions include: Provincial and city labor federations; central industry trade unions, economic group trade unions, general corporation trade unions directly under the Vietnam General Confederation of Labor.
3. Commune, ward, special zone trade unions, inter-commune, ward trade unions; trade unions of industrial parks, economic zones, export processing zones, high-tech zones (collectively referred to as trade unions of industrial parks); trade unions of central non-business units; national universities, regional universities, other universities; Vietnam Fisheries Trade Union; trade unions of economic groups, corporations directly under grassroots-level trade unions; grassroots trade unions, grassroots trade unions.
The Standing Committee of the Vietnam General Confederation of Labor promulgates guidelines on criteria for recognizing grassroots levels or assigning grassroots level powers to commune and ward trade unions, special zones, inter-communal and ward trade unions; trade unions of industrial parks; trade unions of central non-business units; national university trade unions, regional universities, and other universities; Vietnam Fisheries Trade Union; economic group trade unions, corporations directly under grassroots-level trade unions in eligible units.
Article 8. Trade union congresses and conferences at all levels
1. Trade union congresses at all levels
a) Mission of the congress
- Summarize the situation of implementing the resolution of the trade union congress in the past term; decide on directions and tasks for the next term.
- Discuss and contribute opinions on documents of trade union congresses at the same level and at higher levels (if any).
- Election of the trade union executive committee, direct election of the grassroots trade union chairman (if any) and election of delegates to attend the upper-level trade union congress.
- Approving the Charter of the Vietnam Trade Union (for the Vietnam Trade Union Congress).
b) Term of trade union congresses at all levels: Trade union congresses at all levels are held every five-year term. The term of the lower-level trade union congress may be adjusted to suit the term of the upper-level trade union congress and the actual situation. The Vietnam Trade Union Congress is decided by the Executive Committee of the Vietnam General Confederation of Labor after receiving opinions from competent authorities.
c) Trade union congresses have two forms: Delegate congress and full membership congress.
d) Official delegate composition of the congress of delegates.
- Incumbent member of the Executive Committee.
- Delegates elected by lower-level trade unions.
- Appointed delegates with a number not exceeding five percent (5%) of the total number of officially convened delegates. Special cases are decided by the Standing Committee of the Vietnam General Confederation of Labor.
e) Delegates attending the congress must be appraised by the congress and voted to recognize their delegate status. People who are in the period of serving disciplinary actions from reprimand or higher, people who are prosecuted, investigated, prosecuted, tried or are serving criminal sentences according to legal regulations are not qualified as delegates.
2. Trade union conferences at all levels
a) Places that do not meet the conditions for organizing congresses and are agreed by the upper-level trade union shall organize delegate conferences or plenary conferences. In case a delegate conference or plenary conference cannot be organized, an expanded trade union executive committee conference may be organized after obtaining the consent of the upper-level trade union.
b) Trade union conferences at all levels include the following tasks: Reviewing the implementation of congress resolutions; supplementing orientations, tasks, programs, and operating plans of their level's trade union; contributing opinions to documents of higher-level trade union congresses (if any); electing delegates to attend congresses or conferences of higher-level trade union delegates, supplementing the executive committee (if any).
c) Delegates attending trade union conferences at all levels shall implement as prescribed in points d and d, clause 1 of this Article.
Article 9. Principles and forms of election at trade union congresses and conferences
1. Trade union congresses and conferences at all levels are valid when at least two-thirds (2/3) of the total number of members convened to attend.
2. Form of election
a) Secret ballot is conducted in the following cases: Electing executive committees and positions of trade union executive committees at all levels; electing inspection committees and positions of trade union inspection committees at all levels; electing heads and deputy heads of trade unions and other trade union official positions; electing delegates to attend upper-level trade union congresses; taking votes to introduce personnel to be included in the election list.
b) Voting by raising hands or using trade union membership cards in the following cases: Electing executive agencies, assisting congresses and conferences (chairman's delegation, secretary delegation, delegate status verification board, vote counting board); approving the number and list of voters; approving resolutions of congresses and conferences.
3. The elected person must have a number of votes exceeding one-half (1/2) of the total number of delegates summoned to attend the congress and conference and according to the principle of taking from highest to lowest.
Article 10. Trade union executive committees at all levels
1. The Executive Committee of a trade union level is elected by the trade union congress of that level, representing union members and workers of that level. The Executive Committee of a lower-level trade union must be directly recognized or appointed by the upper-level trade union. The Chairman of the new term of the Vietnam General Confederation of Labor, on behalf of the Executive Committee, signs a document recognizing the Executive Committee, the Standing Committee, the Inspection Committee, and the positions in the Executive Committee and the Inspection Committee of the Vietnam General Confederation of Labor.
2. In necessary cases, the upper-level trade union directly appoints the executive committee, executive committee members and positions in the lower-level trade union executive committee. If the entire executive committee is appointed, within a period of no more than 12 months from the date of appointment, the appointed executive committee must organize a congress, conference (delegate or plenary) to elect a new executive committee. The upper-level trade union directly adjusts the operating time of the lower-level trade union executive committee in accordance with the term of the upper-level trade union.
3. The number of members of the trade union executive committee of which level is decided by the trade union congress of that level and does not exceed the number according to the regulations of the Standing Committee of the Vietnam General Confederation of Labor. In case it is necessary to increase the number of executive committee members compared to the number approved by the congress or exceed the number according to the regulations of the Vietnam General Confederation of Labor, it is necessary to ask for written opinions and must have the consent of the directly superior trade union before carrying out the process and procedures for additional elections according to regulations, but not exceeding ten percent (10%). In case the number of members of the Executive Committee of the Vietnam General Confederation of Labor is increased, it is decided by the Executive Committee of the Vietnam General Confederation of Labor, but not exceeding five percent (5%) compared to the number of members of the Executive Committee of the Vietnam General Confederation of Labor decided by the Vietnam Trade Union Congress.
4. The election of additional members of the trade union executive committee at all levels is carried out according to the guidance of the Standing Committee of the Vietnam General Confederation of Labor.
5. The termination of participation in the executive committee of trade unions at all levels
a) Members of the executive committees of trade unions at all levels when retiring, resigning while waiting for retirement, resigning; resigning from holding positions or positions or transferring to other places not belonging to the executive committee structure; executive committee members who are full-time trade union officials when they are no longer full-time trade union officials will naturally cease to be members of the executive committee of that level and superiors (if any), from the time recorded in the decision on retirement, resignation while waiting for retirement, resignation, transfer or notification from a competent authority. In case full-time trade union officials cease to be full-time trade union officials, but continue to be structured as members of the executive committee of that level, the superior-level trade union standing committee decides on continuing to be a member of the executive committee of the trade union.
b) Members of the executive committee of the trade union who request to resign from participating in the executive committee or positions in the executive committee that do not fall into the cases specified in point a, clause 6 of this Article must make a petition and send it to the executive committee of the trade union at the same level for consideration, consensus and request the superior trade union to consider and decide.
6. Responsibilities and powers of trade union executive committees at all levels
a) Trade union executive committees at all levels decide issues within the scope of tasks and powers as prescribed; prepare reports and be responsible for activities before congresses and conferences of trade unions at the same level, upper-level trade unions and lower-level trade unions.
b) Representing and protecting the legitimate and lawful rights and interests of union members and employees under the subjects and scope according to decentralization.
c) Organize the implementation of resolutions of trade union congresses at the same level, guidelines, resolutions, regulations of the Party, policies and laws of the State.
d) Directing, guiding, inspecting, and supervising activities for lower-level trade unions.
e) Electing the standing committee, electing the inspection committee; electing the titles of chairman, vice chairman, chairman of the trade union inspection committee of the same level.
e) Organize questioning and answering questions from trade union officials and members at executive committee conferences.
g) Periodically report on the situation of trade union organization and activities to the Party Committee at the same level (if any), to the directly managing upper-level trade union and notify the lower-level trade union.
h) Manage trade union finances, assets and economic activities in accordance with the law and regulations of the Vietnam General Confederation of Labor.
8. The Executive Committee of the Vietnam General Confederation of Labor; upper-level grassroots trade unions; commune and ward trade unions, special zones, inter-communal and ward trade unions; trade unions of industrial parks; trade unions of central non-business units; national universities, regional universities, and other universities; Vietnam Fisheries Trade Union; economic groups and corporations directly under upper-level grassroots trade unions meet periodically every six months; grassroots trade union executive committees meet periodically every three months; trade union executive committees at all levels meet unexpectedly when necessary.
Article 11. Trade union standing committees at all levels
1. The standing committees of trade unions at all levels are elected by the executive committee of the same level, the number of members of the standing committee does not exceed one-third (1/3) of the total number of members of the executive committee of the same level; the standing committee includes the chairman, vice chairman and members.
2. Trade union standing committees at all levels are responsible for preparing the content of conferences of trade union executive committees at the same level; resolving regular work, directing the organization of the implementation of resolutions of trade union executive committees at the same level and upper-level trade unions. Being issued resolutions, decisions, programs, conclusions and other appropriate documents to organize the implementation of resolutions of congresses at their level, resolutions of congresses of upper-level trade unions and Resolutions of the Vietnam Trade Union Congress, resolutions of trade union executive committees at the same level and upper-level trade unions. Representing union members and workers to propose to the Party and State issues related to workers and trade union organizations.
3. The Standing Committee of the Standing Committee (where there is no standing committee, which is the executive committee) of trade unions at all levels, including the chairman and vice chairmen, on behalf of the standing committee (executive committee), direct, urge, and inspect the implementation of guidelines, resolutions, decisions, conclusions, and work programs of higher-level trade unions; solve daily tasks of the standing committee; decide to convene and prepare the content of conferences of the standing committee of trade unions at the same level.
4. The Chairman is the head of the executive committee, responsible for managing the activities of the standing committee, executive committee, and is the legal representative of the executive committee of the trade union at the same level.
5. The Standing Committee of the Vietnam General Confederation of Labor and the standing committee of the provincial and city labor federations, central industry trade unions, economic group trade unions, and general corporations directly under the Vietnam General Confederation of Labor have a specialized apparatus to advise and assist in trade union work.
6. The Standing Committee of trade unions at all levels meets periodically at least once every two months, and meets unexpectedly when needed.
Chapter IV
TRADE UNION LEVELS IN THE VIETNAM TRADE UNION SYSTEM
Article 12. Vietnam General Confederation of Labor
1. Decide on the program and content of trade union activities to implement the resolutions of the Vietnam Trade Union Congress and resolutions of the Communist Party of Vietnam; direct and guide the activities of trade union levels. Propagate the Party's guidelines and policies, the State's policies and laws and the tasks of the Trade Union organization. Direct the work of studying trade union theory, summarizing practices on the working class and trade union activities.
2. Participate in state management, socio-economic management; participate in building and criticizing draft legal documents, plans, programs, projects, schemes, policies directly related to the rights and interests of trade union members and workers; participate in inspection, examination, and supervision of the implementation of regimes, policies, laws on socio-economics, labor, employment, wages, social insurance, health insurance, unemployment insurance, occupational safety and health and other policies and laws related to workers and trade union organizations, rights and obligations of workers according to the provisions of law; organize and manage scientific research on labor, trade unions, occupational safety and health; participate in committees, councils, and national steering committees on issues related to workers.
3. Coordinate with Party agencies, State agencies, and businesses in fostering and improving the cultural, political, professional, and vocational qualifications of union members and workers to meet the requirements of industrialization and modernization of the country. Coordinate with state management agencies, the Vietnam Fatherland Front and mass organizations at the Central level to organize patriotic emulation movements, conduct supervision, social criticism and social activities among union members and workers.
4. Decide on orientations and measures on organizational and personnel work; build organizational structure and apparatus, standards for trade union official titles; plan, train, foster, manage, arrange, use and implement policies for full-time trade union officials according to management decentralization.
5. Guide and direct activities to represent, care for, and protect union members and workers, patriotic emulation movements and cultural, sports, and tourism activities of trade unions at all levels.
6. Promulgate framework regulations on the principles, contents, and methods of implementing working relationships between central and equivalent industry trade unions, corporation trade unions directly under the Vietnam General Confederation of Labor and provincial and city labor federations in directing, guiding, supporting, and consulting trade union activities according to industries in provinces and cities.
7. Guide and manage international cooperation activities on trade unions according to the provisions of law. The Standing Committee of the Vietnam General Confederation of Labor shall specify the management of international cooperation activities on trade unions according to the provisions of law.
8. Exercise the right and responsibility to manage and use assets; guide and direct the management of finances, assets and trade union economic activities; approve annual finalization and financial estimates of trade unions according to the provisions of law and guidance from competent authorities.
Article 13. Provincial and city labor federations
1. Provincial and city labor federations organized according to administrative units of provinces and cities, decided by the Standing Committee of the Vietnam General Confederation of Labor to establish, split, merge, merge or dissolve in accordance with the provisions of law.
2. The gathering objects of provincial and city labor federations are union members and workers according to provincial administrative boundaries, except for the gathering objects of central industry trade unions, economic group trade unions, and general corporation trade unions directly under the Vietnam General Confederation of Labor.
3. Provincial and city labor federations decide to establish, separate, merge, merge, dissolve and direct the operation of subordinate trade unions.
4. Tasks, powers
a) Representing, caring for and protecting the legitimate and lawful rights and interests of union members and workers in the area.
b) Propagating and organizing the implementation of the Party's guidelines and policies, the State's policies and laws, socio-economic development plans, national defense and security in localities, and the tasks of the Trade Union organization.

- Participate in building and criticizing draft legal documents, plans, programs, projects, schemes, and policies directly related to the rights and interests of trade union members and workers; participate in administrative reform, corruption prevention and control, wastefulness, and negativity; participate in building a strong Party and government.
c) Presiding over supervision or participating with competent state agencies in conducting inspections, examinations, and supervisions of the implementation of regimes, policies, and laws on trade unions, labor, employment, wages, social insurance, unemployment insurance, health insurance, occupational safety and health, collective labor agreements, implementation of democracy at the grassroots level and other policies and laws related to the legitimate and lawful rights and interests of union members and workers in units and enterprises; guiding and directing the settlement of labor disputes, participating in investigating labor accidents and occupational diseases in enterprises in the area.
d) Direct subordinate trade unions to perform tasks according to regulations.
e) Coordinate and guide grassroots trade unions directly under central industry trade unions, economic group trade unions, and general corporations directly under the Vietnam General Confederation of Labor located in the area to operate according to industries; implement directives and resolutions of the Party, policies and laws of the State, guidelines and plans for socio-economic development, security, and national defense in localities.
e) Mobilize and organize for union members and workers to study to improve their political, legal, professional, and vocational qualifications; organize cultural and sports activities for union members and workers; manage trade union institutions, educational and training institutions, and counseling and support centers for workers.
g) Performing personnel work according to decentralization; coordinating with equivalent Party committees in arranging, assigning, and promoting cadres according to decentralization.
h) Guiding and directing congresses and conferences of lower-level trade unions; directing the development of union members, managing union members; evaluating and ranking the quality of trade union organizations annually; organizing training and fostering professional qualifications, nghiệp vụ, and trade union work skills for trade union officials directly in charge.
i) Implement international cooperation on trade unions according to the regulations of the Vietnam General Confederation of Labor.
k) Manage and use the finances, assets and economic activities of trade unions in accordance with the law and the Vietnam General Confederation of Labor.
l) Implement information, reporting and other tasks as prescribed.
Article 14. Central Industry Trade Union
1. Central industry trade unions are organized in the same industry, with a national scope, decided by the Standing Committee of the Vietnam General Confederation of Labor to be established, split, merged, merged or dissolved in accordance with the characteristics of the industry.
2. The gathering objects of the central industry trade union are union members who are active in subordinate trade unions according to decentralization and employees working in units and enterprises in the same industry.

- Research, participate in building and criticizing draft legal documents, plans, programs, projects, schemes, and policies directly related to the rights and interests of trade union members and workers in industries; participate in administrative reform, corruption prevention and control, wastefulness, and negativity; participate in building a clean and strong Party, building sustainable agencies, units, and sectors.
- Presiding over supervision or participating with competent state agencies and trade unions at all levels to conduct inspections, examinations, and supervisions of the implementation of regimes, policies, and laws on trade unions, labor, employment, wages, social insurance, unemployment insurance, health insurance, occupational safety and health, collective labor agreements, implementation of democracy at the grassroots level and other regimes and policies related to the rights and interests of union members and workers in the industry; participating in industry councils to resolve issues related to union members and workers; proposing to state agencies to amend, supplement and resolve industry regimes and policies to meet industry development requirements.
- Coordinate with state management agencies, professional departments and trade unions at all levels to guide and organize patriotic emulation movements and social activities suitable to the characteristics of the industry.
e) Research and propose to the Standing Committee of the Vietnam General Confederation of Labor on arranging and streamlining the organizational structure, improving the efficiency, effectiveness, and effectiveness of the industry trade union; implement planning, management, training, and fostering trade union officials and personnel policies according to decentralization.
e) Directing and guiding lower-level trade unions
- Implementing directives and resolutions of the Party, upper-level trade unions and resolutions of central industry trade union congresses.

g) Proactively coordinate with provincial and city labor federations to develop regulations on coordination to direct and guide affiliated trade unions to implement contents on labor regimes and policies in the industry; propaganda and education of industry traditions; orientations and tasks for industry development; establishing trade unions in non-state-owned enterprises with the same industries; coordinating to direct affiliated trade unions located in provinces and cities to participate in building and developing the socio-economy of the locality; representing and protecting the legitimate and lawful rights of union members and workers; caring for the interests of union members, contributing to building harmonious, stable and progressive labor relations.
h) Guiding and directing congresses and conferences of lower-level trade unions; directing the development of union members, managing union members, and mobilizing the establishment of trade unions in units and enterprises in the same industry. Assessing and ranking the quality of trade union organizations annually according to the guidance of the Standing Committee of the Vietnam General Confederation of Labor.
i) Implement international cooperation on trade unions according to the regulations of the Vietnam General Confederation of Labor.
k) Manage and use the finances, assets and economic activities of trade unions in accordance with the law and the Vietnam General Confederation of Labor.
l) Implement information, reporting and other tasks as prescribed.
Article 15. Trade unions in the Vietnam People's Army
1. Trade unions in the Vietnam People's Army are central industry trade unions belonging to the Vietnam Trade Union organization system.
2. Trade unions in the Vietnam People's Army gather cadres, workers, defense officials, and employees working in enterprises and grassroots units in the Vietnam People's Army according to regulations.
3. Trade union organization and activities in the Vietnam People's Army are regulated by the Standing Committee of the Vietnam General Confederation of Labor after agreeing with the competent authority of the Ministry of National Defense on the principle of ensuring compliance with the provisions of the Trade Union Law and the Charter of the Vietnam Trade Union.
4. Implement information, reporting and other tasks according to regulations.
Article 16. Trade unions in the Vietnam People's Public Security Forces
1. Trade unions in the Vietnam People's Public Security Forces are central industry trade unions belonging to the organizational system of the Vietnam Trade Union.
2. Trade unions in the Vietnam People's Public Security Forces gather officials, workers, and laborers working in units and enterprises in the Vietnam People's Public Security Forces according to regulations.
3. The organization and operation of the Trade Union in the Vietnam People's Public Security Forces are regulated by the Standing Committee of the Vietnam General Confederation of Labor after agreeing with the Party Committee of the Central Public Security on the principle of ensuring compliance with the provisions of the Law on People's Public Security, the Law on Trade Unions, and the Charter of the Vietnam Trade Union.
4. Implement information, reporting and other tasks according to regulations.
(*) Article 17. Trade unions of economic groups and corporations directly under the Vietnam General Confederation of Labor
1. Economic groups and corporations established by the Government are considered and decided by the Standing Committee of the Vietnam General Confederation of Labor to establish trade unions of economic groups and corporations directly under the Vietnam General Confederation of Labor.
2. Collected objects of economic group trade unions, corporations directly under the Vietnam General Confederation of Labor are union members, employees in units and enterprises directly under economic groups, corporations and trade union specialized departments and units.
3. Trade unions of economic groups and corporations directly under the Vietnam General Confederation of Labor decide to establish, merge, merge, transfer, receive, split or dissolve affiliated trade unions in accordance with the law and the Charter of the Vietnam Trade Union, in accordance with the requirements of production, business and operation tasks of organizations, units, and enterprises.
4. Tasks, powers:

- Presiding over supervision or participating with competent state agencies and trade unions at all levels to conduct inspections, examinations, and supervisions of the implementation of regimes, policies, and laws on trade unions, labor, employment, wages, social insurance, unemployment insurance, health insurance, occupational safety and health, collective labor agreements, implementation of democracy at the grassroots level and other regimes and policies related to the rights and interests of union members and workers; participating in councils of units and enterprises to resolve issues related to union members and workers; proposing to state agencies to amend, supplement and resolve regimes and policies related to union members and workers.

k) Manage and use the finances, assets and economic activities of trade unions in accordance with the law and the Vietnam General Confederation of Labor.

Commune, ward, special zone trade unions, inter-commune, ward trade unions; trade unions of industrial parks; trade unions of central non-business units; national university trade unions, regional universities, other universities; Vietnam Fisheries Trade Union; economic group trade unions, corporations directly under grassroots-level trade unions are established corresponding to administrative units, by industry, occupation, in accordance with the legitimate needs and aspirations of union members and workers.
2. Tasks, powers:
a) Representing, caring for and protecting the legitimate and lawful rights and interests of union members and workers in accordance with the law.
b) Guiding and supporting the executive committees of grassroots trade unions and grassroots trade unions on professional skills, methods, contents of organizing the implementation of tasks, guidelines and resolutions of trade unions; propagating and mobilizing union members and workers to implement the Party's guidelines and policies, the State's policies and laws, and the obligations of citizens and workers.
c) Guiding and supporting grassroots trade unions, grassroots trade unions or representing union members and workers to organize dialogues and collective bargaining in accordance with the law.
d) Develop union members, manage union members, establish grassroots-level trade unions according to decentralization; train skills and nghiệp vụ for grassroots-level trade union officials; evaluate and classify trade union organizations annually.
e) Organize patriotic emulation movements among union members and workers; participate with local authorities and professional departments at the same level in socio-economic development solutions in localities, units, businesses, and industries.

h) Manage and use trade union finances and assets in accordance with the law and the Vietnam General Confederation of Labor.
i) Implement information and reporting regimes according to regulations.
k) Exercise other rights, duties and powers.
Article 19. Grassroots trade unions, grassroots trade unions
1. Conditions for establishing grassroots trade unions and professional unions
a) The grassroots trade union is the grassroots organization of the Vietnam Trade Union, established in one or more units or enterprises, when there are 05 or more union members or employees, who have voluntarily applied to join the Vietnam Trade Union.
b) Grassroots trade unions are grassroots organizations of the Vietnam Trade Union, gathering people working without labor relations, in the same industry or other specialized workers, established when there are 05 union members or 05 or more workers, who have voluntarily applied to join the Vietnam Trade Union.
2. Procedures for establishing and dissolving grassroots trade unions and grassroots trade unions are implemented according to the guidance of the Standing Committee of the Vietnam General Confederation of Labor.
3. Types and forms of organization of grassroots trade unions and grassroots trade unions
a) Grassroots trade unions include grassroots trade unions of non-business units; grassroots trade unions of enterprises; grassroots trade unions of cooperatives, unions of cooperatives; grassroots trade unions of departments and units specializing in trade unions and grassroots trade unions.
b) Grassroots trade unions have or do not have member grassroots trade unions, departmental trade unions, trade union groups; grassroots trade unions have or do not have trade union groups, decided by the executive committee of the grassroots trade union, grassroots trade union.
4. Tasks and powers of grassroots trade unions and grassroots trade unions
a) Organize the implementation of resolutions of their grassroots trade union and upper-level trade unions, comply with the Charter of the Vietnam Trade Union; propagate and mobilize union members and workers to implement the Party's guidelines and policies; policies and laws of the State, citizens' obligations; guidelines and resolutions of the Trade Union.
b) Representing union members in dialogue, negotiation with relevant subjects and proposing to local authorities, agencies, departments, branches, units, businesses, and residential communities to ensure jobs, income, living standards, occupational safety and health, labor and social security policies for union members and workers.
c) Collect opinions and aspirations of trade union members to help or propose to competent organizations and individuals to promptly resolve to ensure the legitimate and lawful rights and interests of union members.
d) Presiding over supervision or participating in supervision of the implementation of policies, laws, regulations, rules, collective labor agreements and issues related to the legitimate and lawful rights and interests of union members and employees at the workplace in accordance with the law.
d) Coordinate with employers (if any) to implement the Law on implementing democracy at the grassroots level; care for the material and spiritual life, improve professional qualifications and skills, improve working conditions and health care for workers; organize emulation movements; actively participate in cultural, sports, and social charity activities launched by trade unions at all levels; unite and help union members in their profession and life; participate and support agencies, departments, branches, and residential communities to ensure political security, order, and social safety.
e) Implement the work of developing and managing union members; training and fostering trade union officials; innovating and improving the quality of trade union activities, contributing to building sustainable units and enterprises; actively participating in building a clean and strong Party and government.
g) Implement the management and use of trade union finances and assets in accordance with the law and the Vietnam General Confederation of Labor.
Article 20. Joining the Vietnam Trade Union of the organization of employees at enterprises
1. Organizations of employees at enterprises that are established and operate legally and agree with the Charter of the Vietnam General Confederation of Labour, voluntarily join the Vietnam General Confederation of Labour, are considered for joining the Vietnam General Confederation of Labour.
2. The grassroots trade union of the enterprise has the right and responsibility to link activities with the organization of employees at the enterprise.
Chapter V
FEMALE TRADE UNION WORK
Article 21. Women's work
1. Women's work is the task of the executive committee of the trade union at each level, aiming to promote the role and ensure the legitimate and lawful rights and interests of female union members and female workers in accordance with the law and the Trade Union organization.
2. The Standing Committee of the Vietnam General Confederation of Labor guides the establishment and personnel work for mass women's affairs.
Article 22. Responsibilities of women's affairs
1. Participate in implementing regimes, policies, and laws related to female labor; implement activities on gender, gender equality, for the development of women; female cadre work, population, reproductive health; family and children's work.
2. Organize movements among female union members and female workers.
3. Representatives participate in resolving issues directly related to female union members, female workers and children.
4. Integrate the activities of the women's union association with women's trade union activities.
Chapter V
FINANCE AND TRADE UNION ASSETS
Article 23. Trade union finance
1. Trade unions shall manage and use finances in accordance with the law and the regulations of the Vietnam General Confederation of Labor. Trade union finance includes the following revenue sources:
a) Trade union dues paid monthly by union members are equal to 0.5% of the salary level used as the basis for social insurance contributions.
b) Trade union funds contributed by enterprises, non-100% salary-receiving public service units from the state budget, cooperatives, cooperative unions and other agencies, organizations, and units using labor according to the provisions of law, at 2% of the salary fund as the basis for compulsory social insurance contributions for employees according to the provisions of the Trade Union Law.
c) State budget support;
d) Other sources of income from cultural, sports, and economic activities of the Trade Union; from topics, projects, and schemes assigned by the State; from legal aid and sponsorship of domestic and foreign organizations and individuals in accordance with the law.
2. Trade union finance is used for the following tasks:
a) Performing activities to represent and protect the legitimate and lawful rights and interests of trade union members and workers; participating in building progressive, harmonious and stable labor relations;
b) Propagating, disseminating, and educating the Party's guidelines and policies, the State's policies and laws; improving the qualifications, expertise, professional skills, and working style for trade union members and workers;
c) Visiting and subsidizing union members and workers when they are sick, pregnant, in difficulty, or in distress; organizing other care activities for union members and workers;
d) Developing trade union members, establishing trade union organizations, grassroots trade unions and building strong trade unions;
e) Training and fostering trade union officials; training and fostering excellent workers to create a source of officials for the Party, State and Trade Union organizations;
e) Organize emulation movements chaired or jointly launched by the Trade Union;
g) Organizing cultural, sports, sightseeing, and tourism activities for trade union members and workers;
h) Commending and encouraging employees and employees' children who have achievements in studying and working;
i) Investing in building social housing for union members and employees to rent; cultural, sports, and technical infrastructure works related to serving union members and employees in accordance with the law;
k) Activities to ensure gender equality in accordance with the functions and tasks of the Trade Union organization;
l) Scientific research, technology, innovation and digital transformation of the Trade Union organization;
m) Administrative management expenses to serve the activities of Trade Union organizations at all levels, international cooperation activities of Trade Unions;
n) Paying salaries, allowances and amounts payable according to salary to full-time trade union officials, operating allowances for non-full-time trade union officials;
o) Support for non-specialized trade union officials during periods of job interruption, unable to return to their old jobs due to being terminated labor contracts, working contracts, forced to quit or illegally fired by employers;
p) Supporting grassroots trade unions where they are exempted, reduced or temporarily suspended from paying trade union fees as prescribed by the Trade Union Law to care for trade union members and employees;
q) Social activities chaired or coordinated by the Trade Union;
r) Other expenditure tasks as prescribed by law.
3. Trade union financial management
a) Trade union finance is managed according to the principles of centralization, publicity, transparency, thrift, and efficiency. Implement the assignment and decentralization of management, linking powers with the responsibilities of trade unions at all levels.
b) The Executive Committee and Standing Committee of trade unions at all levels have the task of managing trade union finances in accordance with the law and regulations of the Vietnam General Confederation of Labor.
c) Annually, the Vietnam General Confederation of Labor reports to the Standing Committee of the Central Committee of the Vietnam Fatherland Front on the estimate and finalization of trade union finances of the Vietnam Trade Union.
Article 24. Trade Union assets
1. Trade union assets are formed from contributions of trade union members, trade union finance, trade union capital sources; assets allocated by the State in kind; assets invested in construction, purchased from the state budget and other sources in accordance with the provisions of law are Trade Union assets.
2. The Vietnam General Confederation of Labor exercises the right and responsibility to manage and use assets in accordance with the law.
3. Trade unions at all levels, public service units of the Trade Union are assigned by the Vietnam General Confederation of Labor to manage and use assets; be responsible before the Vietnam General Confederation of Labor and before the law for the use and management of those assets.
Chapter VII
INSPECTION AND SUPERVISION OF TRADE UNIONS AND TRADE UNION INSPECTION COMMITTEES AT ALL LEVELS
Article 25. Inspection and supervision work
Inspection and supervision by the Trade Union is the task of the trade union executive committee at each level, in order to ensure the implementation of the Charter, resolutions and regulations of the Trade Union organization. Each level of trade union must organize and conduct inspection and supervision at its level and be subject to the inspection and supervision of the upper-level trade union.
Article 26. Trade Union Inspection Committee
1. The Trade Union Inspection Committee is elected by the trade union executive committee of the same level and must be directly recognized by the superior trade union. The Inspection Committee of the Vietnam General Confederation of Labor is recognized by the Executive Committee of the Vietnam General Confederation of Labor.
2. Trade union inspection committees at all levels work according to the principle of democratic centralism, under the leadership of the trade union executive committee of the same level and the guidance and direction of the upper-level trade union inspection committee. The trade union inspection committee is responsible to the trade union executive committee of the same level for the results of inspection and supervision organized by the trade union inspection committee.
3. The number of inspection committee members is decided by the trade union executive committee of the same level, including some members in the executive committee and some members outside the executive committee; the number of trade union executive committee members of the same level participating in the inspection committee does not exceed one-third (1/3) of the total number of inspection committee members. In case it exceeds 1/3, it is considered and decided by the superior trade union.
4. Principles, regulations and forms of election of the inspection committee, chairman, deputy chairman of the inspection committee such as election of the executive committee and titles in the trade union executive committee, in which:
a) The Chairman of the trade union inspection committee of which level is elected by the executive committee of that level, and the deputy chairman of the inspection committee is elected by the inspection committee.
b) Grassroots trade unions, grassroots trade unions with fewer than 30 union members, propose that the directly managing upper-level trade union appoint 01 member of the trade union executive committee to perform inspection work.
5. When newly established, split, merged, or consolidated trade union organizations, the directly managing superior trade union shall appoint an inspection committee and positions in the inspection committee.
6. Term of the trade union inspection committee according to the term of the trade union congress at the same level.
7. Members of the trade union inspection committees at all levels when retiring, waiting for retirement, resigning, or no longer being full-time trade union officials or transferring jobs that are not under the structure of participating in the trade union inspection committee, will naturally cease to be members of the trade union inspection committee, from the time of retirement, waiting for retirement, resigning, or no longer being full-time trade union officials or transferring jobs recorded in the decision or notice of the competent authority.
8. When there is a vacancy of a trade union inspection committee member at any level, the executive committee of that level trade union shall carry out procedures and procedures for additional elections according to regulations. If necessary, directly appointed by the upper-level trade union.
Article 27. Responsibilities and powers of trade union inspection committees at all levels
1. Mission
a) Inspect and supervise the compliance with the Charter of the Vietnam Trade Union for trade union organizations at the same level and lower levels.
b) Inspect, supervise and propose timely handling when organizations, officials, and union members at the same level and lower levels show signs of violating the Charter of the Vietnam Trade Union, resolutions, regulations, and decisions of the trade union.
c) Inspect and supervise the collection, distribution, management, and use of finances and assets of the Trade Union, economic activities of trade unions at the same level and lower-level trade unions in accordance with the law and the Vietnam General Confederation of Labor.
d) Supervising trade union organizations, executive committee members, trade union officials at the same level and lower levels on the implementation of the Charter, resolutions, directives, decisions and regulations, rules of the trade union organization and regulations of the Party and State.
d) Advising and handling disciplinary actions against Trade Union organizations, officials, union members of the same level and subordinates when there are violations according to regulations.
e) Resolve complaints and denunciations under the jurisdiction of the trade union organization; participate with state functional agencies and employers in resolving complaints and denunciations of union members and employees in accordance with the law.
g) Organize training and professional guidance on trade union inspection and supervision work for members of the trade union inspection committee at the same level and lower levels.
2. Powers
a) Inspect and supervise trade union organizations, members of trade union executive committees, trade union officials, trade union members of the same level and subordinates on the implementation of the Charter, resolutions and regulations of trade union organizations, and regulations of the Party and State.
b) Consider and decide on disciplinary action against trade union officials and members when there are violations according to the authority regulations on disciplinary action in the Trade Union organization.
c) Report to the trade union executive committee at the same level on trade union inspection and supervision activities and propose contents and work programs of the trade union inspection committee in the regular meetings of the trade union executive committee.
d) Request the Trade Union organization and the person responsible for the Trade Union organization, trade union officials, and trade union members to be inspected and supervised to be responsible for reporting and providing documents for inspection and supervision work and answering issues related to the content of inspection and supervision.
d) Announcing the conclusions of inspection, supervision and proposing forms of handling to the standing agency of the trade union executive committee at the same level. If the recommendations of the trade union inspection committee are not resolved by the standing agency of the trade union executive committee at the same level, the trade union inspection committee has the right to report to the trade union executive committee at the same level and report to the higher-level trade union inspection committee.
e) The Inspection Committee of the Vietnam General Confederation of Labor, the inspection committee of the provincial and city labor federations, central industry trade unions, economic group trade unions, and general corporations directly under the Vietnam General Confederation of Labor are allowed to use separate seals according to the regulations of the Standing Committee of the Vietnam General Confederation of Labor. The remaining trade union inspection committees at all levels are allowed to use the seals of the trade union executive committees of the same level to operate.
g) Members of the trade union inspection committee are trained, fostered, and improve professional skills in trade union inspection and supervision work; are invited to attend conferences of the executive committee and congresses, trade union conferences at the same level.
Chapter VIII
REWARD - DISCIPLINE
Article 28. Rewards
Trade union organizations, collectives, trade union officials, and trade union members who have achievements and contributions to the development of the trade union organization are considered for commendation according to the regulations of the Standing Committee of the Vietnam General Confederation of Labor.
Article 29. Discipline
1. Trade union organizations, collectives, trade union officials, and trade union members who violate the Charter, resolutions and regulations of the Vietnam General Confederation of Labor, will be disciplined strictly, accurately and promptly depending on the severity.
2. Disciplinary action
a) For Trade Union organizations, executive committees, standing committees, and trade union inspection committees at all levels: Reprimand, warning, dissolution.
b) For trade union officials: Reprimand, warning, dismissal, expulsion.
c) For union members: Reprimand, warning, expulsion.
3. Authority and procedures for disciplinary action in trade union organizations at all levels, implemented according to the regulations of the Standing Committee of the Vietnam General Confederation of Labor.
Chapter IX
COMPLYING WITH THE CHARTER OF THE VIETNAM TRADE UNION
Article 30. Responsibilities for implementing the Charter of the Vietnam Trade Union
Trade union organizations at all levels, trade union officials, and trade union members are responsible for strictly implementing the Charter of the Vietnam Trade Union.
Article 31. Authority to amend, supplement, regulate, and guide the implementation of the Charter of the Vietnam Trade Union
1. Only the Vietnam Trade Union Congress has the authority to amend, supplement and approve the Charter of the Vietnam Trade Union.
2. The Standing Committee of the Vietnam General Confederation of Labor is responsible for stipulating and guiding the implementation of the Charter of the Vietnam Trade Union immediately after being approved by competent authorities for the Charter of the Vietnam Trade Union.
3. For new issues other than the regulations in this Charter, if approved by a competent authority, the Executive Committee of the Vietnam General Confederation of Labor shall consider, decide and direct the implementation.
