In particular, the dossier for reappointment and extension of civil servants holding leadership and management positions until retirement age is based on Article 41.
Article 41. Reappointment documents, extending the term of office in leadership and management positions to retirement age
1. The dossier for the reappointment request shall comply with the provisions of Article 35 of this Decree; for self-review, it shall be carried out throughout the term of office. Regarding the conclusion on political standards, in case of reappointment but with new details that change the previous conclusion, there must be a Conclusion of the competent Party Committee on political standards.
2. The dossier proposes to extend the term of office in leadership and management positions to retirement age, including:
a) The proposal to extend the term of holding a leadership or management position to the retirement age is signed by the head of the agency or organization (in case of submission to a competent authority) or signed by the head of the agency advising on the organization of cadres (in case of decision by the head of the competent authority);
b) Minutes of meetings and results of vote counting to propose extending the time holding leadership and management positions of the collective leadership of agencies and organizations;
c) A personal background check that is self-declared according to the prescribed form, confirmed by the direct management agency, with a 4x6 color photo, taken within no more than 6 months;
d) Self-review and evaluation of the performance of duties and tasks during the term of office;
dd) Regarding political standard conclusions: In case of extending the term of holding leadership and management positions but having new details that change the previous conclusion, there must be a Conclusion of the competent Party Committee on political standards;
e) The assessment of the Party cell where they reside for themselves and their families. In case the place of residence of the person is different from the place of family residence, the comments of the Party cell where the person lives and the place of family residence must be sought;
g) Declaration of assets and income according to the prescribed form;
h) A health certificate issued by a competent medical facility for a period of 6 months.
In case the components in the dossier propose to extend the term of holding leadership and management positions to the retirement age prescribed in Clause 2 of this Article have been approved by competent authorities and exist in the national database, they will be used to replace the corresponding paper version.
