Article 40. Procedures for extending the term of holding leadership and management positions to retirement age
1. No later than 90 days before the expiration date of the appointment term, the competent authority to extend the term of holding a leadership or management position must issue a notice to consider extending the term of holding a leadership or management position to the retirement age for civil servants.
2. Civil servants make self-assessment reports and evaluate the performance of duties and tasks during their tenure, and send them to competent authorities for an extension of their tenure as leaders and managers.
3. The head and the collective leadership of the agency or organization discuss and consider whether the civil servant is still healthy, reputable, and meets the requirements of the task, then vote unanimously by secret ballot.
Personnels proposed to extend their time holding leadership and management positions must reach a rate of over 50% of the total number of members of the leadership team agreeing; in case the personnel reach a rate of 50%, it will be decided by the head; at the same time, fully report different opinions for consideration and decision by competent authorities.
The head of an agency or organization shall make a decision according to his authority or submit it to the competent authority for consideration and decision on extending the term of office of a civil servant in a leadership or management position to the retirement age.
