Accordingly, the Draft Resolution amending and supplementing a number of articles of the 2013 Constitution of the Socialist Republic of Vietnam once again affirmed the position of the Trade Union organization.
Affirming the position of the trade union organization being raised
Recently, the Standing Committee of the Central Committee of the Vietnam Fatherland Front (VFF) reported the results of the consultation in the VFF system on the draft Resolution amending and supplementing a number of articles of the 2013 Constitution of the Socialist Republic of Vietnam.
Based on the synthesis of opinions and recommendations from socio-political organizations, member organizations of the Front and the Vietnam Fatherland Front at all levels, regarding the amendment and supplement in Clause 2, Article 9 of the 2013 Constitution in the draft Resolution, the Standing Committee agreed and proposed to keep the regulations on socio-political organizations under the Vietnam Fatherland Front.
According to the Standing Committee of the Central Committee of the Vietnam Fatherland Front, the addition of this regulation is appropriate and necessary, ensuring the establishment of a foundation for the Decree on the position, relationship, and principles of operation of the Vietnam Fatherland Front and socio-political organizations after the arrangement and streamlining according to the resolutions and conclusions of the Party Central Committee, Politburo, and Secretariat; at the same time, to ensure the nature of voluntary unions as prescribed in Clause 1, Article 9, in Clause 2, Article 9, the principle of democratic commercial cooperation, coordination and unification of actions of the Vietnam Fatherland Front and member organizations, including socio-political organizations, has been supplemented.
In addition, it is recommended to accept comments on the replacement of the phrase "under the chairmanship of the Vietnam Fatherland Front" with the phrase "under the chairmanship of the Vietnam Fatherland Front".
Regarding the Vietnam Trade Union (the content of amending and supplementing Article 10 of the 2013 Constitution), the Standing Committee agreed and proposed to keep the phrase "belonging" in Article 10 in accordance with the amendment and supplementation of Clause 2, Article 9 of the 2013 Constitution in the draft Resolution, ensuring consistency in the provisions of the Constitution.
The Standing Committee agreed to accept comments on adding the phrase "the most unified" and creating a regulation "the only representative of workers at the national level" to clearly affirm the position of the Trade Union in representing workers at the national level in the "working system" and in the "international system of trade unions".
Currently, the Vietnam Trade Union is the "most" representative of workers participating in national committees, councils, and steering committees related to the legitimate and legal rights and interests of workers such as: National Wage Council, Labor Relations Committee, Social Insurance Management Council, etc. In international relations, the Vietnam Trade Union is the representative of Vietnamese workers in bilateral and multilateral cooperation activities (the Vietnam Trade Union is a member of the World Trade Union (WFTU); representative of Vietnamese workers in relations with the International Labor Organization (ILO), the International Trade Union (ITUC, etc.).
Promoting the role of the Trade Union after streamlining the organization and apparatus
At the 7th Executive Committee of the Vietnam General Confederation of Labor Conference, term XIII, 2023-2028, Mr. Do Van Chien - Politburo member, Secretary of the Party Central Committee, Secretary of the Vietnam Fatherland Front Party Committee, Central organizations, Chairman of the Vietnam Fatherland Front Central Committee assessed that the draft Resolution once again affirmed the position of the Trade Union organization being raised, the content of the draft Article 10 stipulates that the trade union "is the only representative of workers at the national level" to clearly affirm the position of the trade union in representing workers at the national level in the "labration of labor" and in the "international relationship of trade unions".
Regarding the issue of union finance, Mr. Do Van Chien analyzed that the Vietnam Fatherland Front is a level I account, a level I budget estimate for the central budget. The Vietnam General Confederation of Labor is a level II budget estimate unit. The level I budget estimate unit will strictly manage and effectively use the State's support budget; while the union budget and union capital are managed by the level II budget estimate unit, but there is an inspection and supervision by the level I budget estimate unit.
Along with the 2013 Constitution, the 2024 Trade Union Law will also be amended and supplemented.
