Suing a company that owes wages, many workers in Gia Lai have their petitions returned to court

Gia Lai - Many workers sued Phuc Thinh Binh Dinh Company Limited for unpaid wages and benefits and were court-issued because they had not yet passed the mandatory mediation step.

On September 13, a representative of the Gia Lai Provincial Federation of Labor (GFF) said that in the face of the situation where 130 workers at Phuc Thinh Binh Dinh Company Limited (headquartered in Nhon Hoa Industrial Park, An Nhon Nam Ward) have been owed wages and benefits for many months, the unit is organizing a mediation session between workers and enterprises.

According to regulations, if after 3 mediations, the two sides cannot find a common voice or the enterprise avoids or does not participate, the employee has the right to sue Phuc Thinh Binh Dinh Company Limited and request the Court to resolve the matter.

A representative of the Provincial Federation of Labor said that in the past, many workers have filed lawsuits against enterprises but were returned by the People's Court of Region 2 - Gia Lai, because they had not yet gone through the mandatory mediation step before requesting the court to resolve the matter.

"Previously, mediators were introduced by the People's Committees at the district level for recognition at the provincial level. However, after the district level was abolished, the team of mediators was dispersed, finding people with a term to participate in the settlement became very difficult. Currently, the Provincial Federation of Labor has coordinated with the Department of Home Affairs to find mediators to organize mediation between businesses and workers," said a representative of the Gia Lai Provincial Federation of Labor.

As Lao Dong has reported, in recent months, more than 100 workers at Phuc Thinh Binh Dinh Company Limited, along with a number of households, have received product contracts and enterprises that are in difficulty because the company owes wages, social insurance, and processing fees for orders up to more than 7 billion VND, and have suddenly stopped production since July 31.

Initial statistics show that Phuc Thinh Binh Dinh Company Limited owes 130 employees wages, with an amount of more than 2.3 billion VND; owes households more than 2.5 billion VND for processing and owes Tan Dat General Trading and Service Company Limited more than 2.3 billion VND. The total debt is more than 7.1 billion VND.

Phuc Thinh Binh Dinh Company Limited has deducted the employee's insurance payment but did not pay it to the Social Insurance agency, causing the employee to quit his job and not receive unemployment insurance; the health insurance card is locked, and the medical examination and treatment costs are not paid. The company also did not pay the Union fund, did not sign labor contracts with more than 100 workers and has not paid salaries since April 2025.

On the afternoon of August 27, the Gia Lai Provincial Federation of Labor and the Provincial Economic Zone Management Board went to work with Phuc Thinh Binh Dinh Company Limited to clarify the situation of unpaid wages and benefits. However, the company gate was closed, the director was absent, while about 60 workers gathered in front of the company gate to request payment for salaries and benefits.
