Law on Trade Union 2012 (currently effective) in Article 16 of the rights and responsibilities of trade unions in the development of trade union members and grassroots trade unions as follows: Trade unions have the rights and responsibilities to develop trade union members and grassroots trade unions in agencies, organizations and enterprises; The superior trade union directly has the right and responsibility to send trade union officials to agencies, organizations and businesses to propagate, mobilize and guide employees to establish, join and operate trade unions.
This content is specified in Article 19 of the Law on Trade Union 2024 (effective from 1.7.2025), adding the phrase "grassroots union". This law stipulates more specific rights and responsibilities of the Trade Union organization as follows: Trade Union has the right and responsibility to develop trade union members, establish grassroots trade unions and grassroots union; The provincial trade unions, the central branch and the equivalent, the superior trade union directly have the right and responsibility to send trade union officials to agencies, organizations, units, businesses, cooperatives and unions of cooperatives to propagate, mobilize and guide workers to join and establish grassroots trade unions.
The trade union at the grassroots level is responsible for propagating, mobilizing, meeting, and guiding workers without labor relations to join and establish grassroots trade unions; the grassroots trade union and grassroots trade unions are responsible for propagating, mobilizing, meeting with workers to join the Trade Union.
Article 19 also stipulates that in cases where workers establish grassroots unions or grassroots unions on their own, the Trade Union shall guide and support workers in establishing a mobilization committee to establish grassroots unions or grassroots unions according to the provisions of the Charter of the Vietnam Trade Union.
Local authorities, specialized agencies under People's Committees at all levels and other relevant agencies and organizations are responsible for creating favorable conditions for trade unions at all levels to exercise their rights and responsibilities in propagating and mobilizing workers to join and establish grassroots trade unions and grassroots trade unions.
Thus, the 2024 Trade Union Law has stipulated more in detail and specifically about this important right and responsibility of the Trade Union organization. The 2024 Trade Union Law also adds the responsibility of local authorities, specialized agencies under People's Committees at all levels and other relevant agencies and organizations for this work.
