Article 20. Use of electronic records of cadres, civil servants, and public employees
1. Electronic dossier components in the National Database on cadres, civil servants, and public employees are used to replace paper dossier components in cadre, civil servant, and public employee management according to the provisions of law and competent authorities.
2. In cases where professional requirements require the use of paper records, management agencies or agencies and units using officials, civil servants, and public employees exploit the electronic records of officials, civil servants, and public employees on the National Database of Officials, Civil Servants, and Public Employees, converting to paper records for use. The conversion to paper records from electronic records is carried out in accordance with the law on electronic transactions. Officials, civil servants, and public employees do not have to redo the components of records already in electronic records.
3. Agencies managing and using cadres, civil servants, and public employees are not allowed to request cadres, civil servants, and public employees to provide information and dossier components that are already in the National Database on cadres, civil servants, and public employees, unless necessary to ensure the legitimate rights and interests of individuals, agencies, and organizations. In case of detecting incorrect information and data, cadres, civil servants, and public employees, agencies managing and using cadres, civil servants, and public employees are responsible for updating information and data within their authority to the electronic dossiers of cadres, civil servants, and public employees.
4. Agencies, organizations, and individuals with authority are only allowed to access and view electronic records of cadres, civil servants, and public employees according to the provisions of law when agreed upon by that person via electronic message. Cadres, civil servants, and public employees have the right to withdraw their agreed opinions. In case of serving cadre work, management agencies or agencies using cadres, civil servants, and public employees are allowed to access and view electronic records of cadres, civil servants, and public employees within the scope of their authority and assigned tasks and have the obligation to protect information security and personal data according to the provisions of law.
