The commune-level Military Command consists of the Commander, Political Commissar concurrently appointed by the Secretary of the commune-level Party Committee, Deputy Commander, Deputy Political Commissar, assistants and technical staff.
The Minister of National Defense decides on the organization, staffing, tasks and titles of the Military Command of commune level, ensuring no increase in total staff according to the decision of the competent authority.
In the Appendix to the list of legal documents that need to be amended and supplemented related to Resolution No. 66.12/2026/NQ-CP dated January 26, 2026, on the organization and operation of the Military Commands of communes, wards, and special zones under the Provincial Military Command, centrally-run cities, the Hanoi Capital Command and the Ho Chi Minh City Command, the Government assigned the Ministry of National Defense to amend the regulations on equivalent positions and the highest military ranks for reserve officers holding the position of Commander of the Military Command at the commune level, as stipulated in Article 15 of Circular No. 77/2020/TT-BQP.
This content is assigned by the Government to the Ministry of National Defense to be completed in 2026.
Article 15 of Circular No. 77/2020/TT-BQP dated June 23, 2020 of the Ministry of National Defense stipulates the implementation of a number of articles of the Law on Militia and Self-Defense Forces on organizing the construction of militia and self-defense forces, stipulating "The Commander of the Military Command of commune level has a position equivalent to the Battalion Commander, the highest military rank is Lieutenant Colonel, reserve officer".
The Law amending and supplementing a number of articles of the Law on Officers of the Vietnam People's Army, effective from December 1, 2024, has stipulated the highest age limit for reserve officers.
The new law stipulates the highest age limit for reserve officers as follows: Captain level: 53 (up 2 years); Major: 55 (up 2 years); Lieutenant Colonel: 57 (up 1 year); Senior Colonel: 59 (up 2 years); Colonel: 61 (up 1 year); General level: 63.
The highest service age limit for commanders of commune-level military commands is implemented according to the provisions of the Labor Code.
The Government also assigned the Ministry of National Defense to propose in 2026 to supplement regulations on positions, equivalent titles and positions of Military Commands at commune level for unified implementation.
Currently, this content is being regulated in Circular No. 11/2025/TT-BQP dated February 17, 2025, which stipulates the positions, equivalent titles and positions with the highest military rank being Colonel and Second Lieutenant of officers of the Vietnam People's Army.
